In the early days of the Duke lacrosse rape case, Durham District Attorney Mike Nifong's public statements appear to have contradicted certain facts in his own files.
After an escort service dancer said three men raped her at a lacrosse party, Nifong talked frequently with national and local reporters -- 50 to 70 interviews consuming 40 hours of his time, Nifong estimated. Nifong then went quiet in early April, refusing most interview requests.
A comparison of his words with documents that Nifong gave defense lawyers show that Nifong made what appear to be misstatements about condom use, a purported struggle and a 911 call made by a second dancer, among other things.
Nifong said the assailants might have used condoms; the accuser told an emergency-room nurse none were used, according to a defense filing. Nifong described a violent attack in which the accuser was choked and struggled to breathe; the accuser told a nurse she wasn't choked, the filing said.
Defense lawyers have filed some of the documents in court and characterized others, such as the medical exam, in affidavits.
Nifong declined through an assistant to answer questions Wednesday.
"Either he knew what the facts were and misstated them, or he was making them up," said James Coleman, a Duke law professor who has publicly requested that Nifong remove himself from the case. "Whether he acted knowing they were false, or if he was reckless, it doesn't matter in the long run. This is the kind of stuff that causes the public to lose confidence in the justice system."

Sad, but oh so true.
LOS ANGELES With new evidence indicating that the alleged victim in the Duke lacrosse rape scandal may have lied, and that Durham District Attorney Michael Nifong misrepresented evidence and left out essential exculpatory information, prominent conservative black minister Rev. Jesse Lee Peterson today issued the following statement regarding the latest developments in this case:
Contrary to what Mike Nifong had said early on in this investigation, the latest reports indicate that the alleged victim showed no physical signs of a sexual assault. Police documents also reveal that the accuser said she had sex with 3-4 other people just days prior to the alleged incident with the players.
This case has exposed the sad and pathetic condition of the black community. Most blacks are so race conscious that theyve already convicted these white players. This is a sad commentary about the state of blacks and their outlook on race. Until blacks acknowledge their own racism toward whites, theyll continue to side with eviljust as they did in the Tawana Brawley fiasco and the O.J. Simpson case.
The DA in this case misled the public about the evidence and exploited the anger and racist sentiments of some of Durhams black population for political gain. Its a shame that black people have once again allowed themselves to be used by a liberal Democrat. This DA has no case and should withdraw the charges immediately.
So.....the officer investigating the possible rape of a hooker is named "Himan?"

Considering the False Accuser's sexual history and drunken demeanor at the party - if anyone needed to take date rape drugs-it was the players.
I wonder if Nifong's magic pills were actually Flexeril in an unmarked bottle or loose on the floor -which he would naturally assume belonged to the players .
Flexeril combined with alcohol would be a defacto date rape drug. Except that it was Crystal doing the combining and ingesting all by her lonesome.
Hopefully , Nifong's " Ahaaa !" moment has turned into another exploding cigar.
Osborn's 5-21 motion quotes Nifong saying he "intends to introduce at trial ... S.B.I. chemical analysis lab report and statement of chain of command." Why would he introduce at trial any drug brought by Crystal? Wouldn't it at least have to be traced to a player, even if Crystal raided the medicine cabinet herself?
Very interesting find on the N&O blog. Of course, this is potentially worse than the Scottsboro boys, because there were actually in the train car, but we do not even know that Finnerty was there.

It's hard to support the law-and-order branch of government when so many fibs and fabrications are being served by the prosecutors.
Named witnesses do not have to be called.
Have you considered that the date rape pills (if there are any) are the AV's, used in kinky sex acts with someone who doesn't like threesomes. I've only heard/seen it in the movies -- really -- but I've heard that some folks like to do that.
