Lacrosse Scandal: The Duke Accuser—New Credibility Questions (Newsweek)

Early in the Duke lacrosse rape investigation, Durham District Attorney Mike Nifong, who was in a close race to keep his job, spoke about the physical and emotional trauma the alleged victim had suffered at the hands of the players. A police affidavit stated that her medical records revealed the victim had "injuries consistent with being raped and sexually assaulted vaginally and anally." But according to a motion filed by defense attorneys last week, no such physical trauma was found during her exam at Duke hospital. Quoting from the report, which was submitted to the court under seal, the motion states that the nurse—who was in training—examined the woman's entire pelvic region and noted only diffuse swelling of the vaginal walls, a condition explainable by consensual sexual activity.

Police documents indicate that the accuser had in fact engaged in such activity in the days leading up to the incident. The accuser told police that she'd had sex with her boyfriend a week before. She added that she'd also performed using a vibrator in front of a couple. (Though the timing of this incident is not specific, the clear implication is that it had happened near the time of the lacrosse party.) And, according to defense attorneys, the boyfriend's seminal fluid was found in her, suggesting she'd also had sex with him within 72 hours. Jarriel Johnson, who identified himself as the woman's driver, told police in a statement that in addition to sleeping with the accuser himself a week prior to the party, he'd taken her to several appointments at hotels in the days before.

Ok what would stop Nifong from hiring Estrich or Wendy Murphy? Thats my point, Nifong isn't being objective in this case and I don't see him picking anyone that is.

I don't think so. A special prosecutor would start all over again, I think. If he just comes in and drops the charges, he won't have done the job he would have been appointed to do.

A judge can get rid of the charges, if that's what should be done.

This case is going to be ridden out to the bitter end, imo. Nifong is not going anywhere at all and he will never give up.

I see no way out for him at all except to go to trial and lose.

I can't help but think that there is something driving this case forward that we don't know about. It should have died a quick death many times over long ago. What in the world is keeping it going?

I'm certain Nifong has no more bullets.

Nifong might certainly have taken it up for political gain. However, knowing what we know now, it seems an awfully shaky and risky case to try to use if Nifong knew what we know.

Part of me still thinks there is just no way Nifong read any of the stuff we know about now, and his attitude about the cell phone, and laughing in court just reinforces the idea.

How the heck is this going to go on until next year?

Our experience is that the D.A. just moves on to other cases and this one goes on the back burner until the others are tried. D.A. won't do anything and there will be nothing the defense can do except move on to other cases until it is closer to trial. It will die of disinterest in the media and that will be that.

Let me just say she is not afraid of the Duke Lacrosse players. She's afraid of some other group or person. White extremist group -- maybe, but more than likely her work has put her in contact with some very unpleasant people. You may take it to the bank she is not afraid of anyone related to Duke.

There is the distinct possibility that she isn't afraid of anyone, but it looks good in print media and on the 6:00 news. As to her being "away" or "on vacation" that's a distinct possibility. Depending where she is staying, she may be getting herself detoxed and ready to come out swinging. She isn't going away -- she makes missile lock look like child's play.

You are granting Nifong too much credit. As one of his colleagues described him - he is "stubborn". He may have simply taken the opportunity for political gain and now finds himself in a corner. Like two people at an auction who get focused on the fight and lose sight of the prize. Unfortunately it is the Duke LAX young men, their parents and the judicial system that will end up paying the price.

We will see, I guess.

I sure would like to see Nifong have to go out campaigning, too.

Oh the questions reporters will try to ask.....

Except in this case Nifong has taken on Duke University too. Now some of that is Duke's doing by throwing the team under the bus. But now that Duke realizes what has gone on and realizes that it has taken hits in the media in NYC and DC, they will not let this die until Nifong drops the charges and likely want Nifong out.

While a significant segment of the Durham population is behind Nifong in this, don't ever under estimate the influence of the more influential group including Duke that must now be sickened by Nifong. I suspect the pressure is growing on him each day.

I think a special prosecutor would come in and review the evidence. After reviewing the evidence a special prosecutor would:

1. file additional charges and go to trial,

2. go to trial on the existing charges,

3. drop some of the charges and go to trail on the remaining charges

4. drop all of the charges, file other charges and go to trial.

5. drop all the charge.

I think any reasonable special prosecutor would take about a week to review the evidence and drop all the charges. But it would depend on such a prosecutor not feeling he had to cover for Nifong a fellow prosecutor.

A judge can get rid of the charges, if that's what should be done

Not exactly. A judge after the prosecution case can direct an acquital. But given these indictment from a grand jury, I am not sure the judge can just throw them out.

Now maybe the judge could throw out her ID and rule her ID is so tainted by the tainted photo arrays that she can not ID the defendants in court. But can't you imagine the judge throwing out her ID and Nifong say he is still going to trial?

I am not sure if the Judge can throw out the indictments since there were based on the ID? Maybe some of the attorneys out there can tell us?

Summary:

1. Every lacrosse player has been deposed by the defense and says all have said the same thing.

2. Furhman say no case.

3. Police report said that night that she is bi-polar.

4. Lis Wiehl spinning calling police reports defense spin.

5. Ex-DA candidate Bishop says there is reasonable doubt. Says Nifong spoke too soon and said things did not pan out.

6. Furhman says the DA did not allow the detectives to investigate the case.

Wiehl is pathetic. More coming.

Hard to believe any attorney would argue that the mental problems of any witness would not be allowed in to challenge their ability to accurately recall events isn't it?
