DURHAM -- The exotic dancer who has accused three Duke lacrosse players of gang-raping her was drinking while taking medication that night, and had sex with at least four men and a sexual device in the days immediately leading up to the off-campus party, according to court papers filed Thursday.
And despite what Durham police have contended, a medical examination showed no signs of the sort of sexual or physical attack of which the dancer complained, according to the motion filed by defense attorneys for Reade Seligmann.
Among other previously undisclosed details, the motion says the woman at one point accused her female dance partner of helping the lacrosse players rape her and of stealing her money.
And she told one medical staffer she drank at least 44 ounces of beer, and told another she took a powerful muscle relaxant and drank beer before going to the party at 610 N. Buchanan Blvd. on March 13.
(Defense lawyers say Detective) Himan knew but did not mention in a probable-cause affidavit that two examining physicians said the dancer complained only of vaginal rape, even though some charges in the case are linked to allegations of oral and anal penetration.
Himan also neglected to note that the accuser told one doctor she was not hit and did not complain of any pain, or that she told the sexual assault nurse examiner she was not choked, according to the documents.
That conflicts with statements from police that the woman was kicked, strangled and beaten while being sexually assaulted.
The paperwork filed Thursday includes lengthy, handwritten statements from the second dancer and from the alleged victim's "driver," along with insights into the accuser's medical condition on the night in question.
Among numerous revelations, the documents say the alleged victim performed with a vibrator for other spectators before going to the North Buchanan Boulevard house late on March 13.
Defense lawyers said the vibrator, rather than a rape, might have caused "signs or symptoms of vaginal penetration."
In addition, the dancer told her driver she was "involved in some sexual manner with at least four different men" between March 10 and 12, and she admitted to a physician the next day that "she was drunk and had had a lot of alcohol that night," according to the documents.
The accuser's medical records were among nearly 1,300 pages of documentation defense lawyers got last month from District Attorney Mike Nifong.
Although the records remain sealed to the public, attorneys Osborn and Conner quoted from them extensively in Thursday's paperwork.
They even have the names of the motels and the room numbers.
Case? AMF.

What a whore! She also has a HISTORY of accusing guys of raping her ... is it one or two kids later ... and who knows who their father is ... throw the case out!

The bigger crime now is that the DA has been allowed to castigate so many members of the Duke Lacrosse team based on the flimsiest of evidence.
The DA withheld info (about the 4 sexual encounters and about the other dancer saying the rape allegations were 'a crock') from the judge issuing the warrants and from the Grand Jury.
Let's cut the crap -- she's a whore. ....and it just gets worse from there.
Right now, the DA's office should ask what damage settlement the boys will take to avoid litigation and an ethics complaint to the bar about DA.

The latest episode in this bizarre case is that the friend of the alleged victim says she was not separated from her fellow dancer/entertainer (I'm being polite in so describing them) for more than 5 minutes and that the rape story was a "crock".
At least two of the defendants can apparently prove that they couldn't have been present according to the prosecutor's time line of events.
The alleged victim has given numerous and conflicting accounts of what happened and when. There is also the evidence of her being drunk in someone else's vehicle and the testimony of the cab driver. And then there's her past charge that a similar event occured before with other men -never substantiated.
It appears the only clear motive in the whole episode was that another out-of-control prosecutor - to win an election - was willing to submit anything to a grand jury, no matter how reckless the charges.
This looks like another modified version of Tawana Brawley and Al Sharpton.

The alleged "victim" and Mike Nifong should both sentenced to life in prison for destroying the lives of the boys she accused. And no matter how much money they have, the families of the three boys should be given restitution for the legal costs they had to incur.
Justice will NOT be served if the case is simply dropped. Too much damage has been done to the boys and their families at this point.

Nifong also shows how corrupt a DA can be. He had to know this was a cr@p case, but he was playing for the vote.
The university itself should sue this prosecutor and the city of Durham NC into tommorrow-morrow land.
In fact, if I were the president of the university, my first move would be to call the mayor of Durham and inform him that no law of physics prevents an entire university from being moved to another town or city, and ask him what he thinks THAT might do for the economy of Durham NC.
