The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Did you see Hannity & Colmes tonight? The guy on the panel, the lawyer, mentioned that possibly the NC State Attorney General should step in, considering this is such a miscarriage of justice by the DA. Think he has been lurking here? LOL!

Well, 3 weeks ago, Jim Hammer was saying if the players were innocent they'd be exercising their right to a speedy trial.

Mike, I'll repeat: I don't know that you're wrong at all. Your conclusion may well be right. I just don't see enough to feel solid about it as a conclusion based on what we know about the incident at this point. Maybe when and if we ever do find out what set her off, it'll turn out that you were right and can say "I told you so" even though I'm not fully disagreeing with you. Before we ever heard about this incident I said she doesn't handle stress like a normal person and probably has an addictive, dependent personality, and I've also speculated that she may be an incest victim. Using a pet name such as "Precious" for her stage name when she's out of it suggests that to me, on top of the other aspects about her that made me suspect it before the "Precious" name came out. So, yeah, I think she has a screw loose, and the getting out the car may or may not have been a manifestation of it. For all we know, he may have slapped her or something. He obviously has left something out, but it could be like you say - she didn't want to be taken home.
The forlorn hope that "Nifong has got to have something in his back pocket" will simply not withstand the avalanche of revalations which are continuing to come out.
