The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Osborn says a man named Jarriel Johnson drove the accuser to the Durham Police Department to pick up her belongings March 21. The motion points to a statement from Johnson saying the accuser engaged in sexual activity with at least four different men from March 10 to March 12.Three young men are having their careers ruined and their lives wrecked on the contradictary account of a drunk whore.
Utterly disgusting.
The father is hoping she'll be in no condition to testify. If/when they open those medical records they might learn some stuff about the father.
I'm involved in the construction industry, and I have met several competent construction superintendents who struggled with drug habits for years before finally finding a way out.
Being intelligent and sensitive are characteristics that all of them have in common. While they were young, they became aware of adult problems in their family or school settings, and as kids, they could not deal with such heavy loads. Despite their parents' efforts to shield them from the harsh realities of life, these kids started to worry about paying rent, or a family member having an intractable disease, or even a pet's death.
It seems that they used drugs to deal with the a pain that most of us don't have. Since I was never that sensitive, and I seldom worried about adult problems when I was a child, I never felt the emotional pain that these young men felt. Therefore, I occasionally tried drugs while in college, but I never became hooked. I didn't have any long-lasting emotional pain that needed a palliative. I could not understand why certain people become hooked.
Which brings me to the solution. Those young men who successfully kicked the habit had to hit bottom, spending time in skid row and jail. Then they found a more healthy way to deal with emotional pain and addiction. One of them became a Buddhist lite, another one does yoga every day when he wakes up, another one became an evangelical Christian, another one plays soccer every day and has organized local teams that play almost every weekend.
I wish your son will find something that will alleviate the emotional pain that only certain subset of men feel. It's a lifetime commitment but it is possible to put the addiction problem to sleep for life.

Mistrial declared in murder case against Amir Belvin

DURHAM -- To the dismay of the dead person's mother, a mistrial was declared Wednesday when jurors could not unanimously decide whether Amir Delon Belvin fatally shot a man and wounded two others outside a Durham nightspot seven years ago.
The mistrial came after jurors indicated they were hopelessly deadlocked at 8-4, in favor of not guilty, on a charge of second-degree murder and 7-5 on two assault charges against Belvin.
The case could be retried if prosecutor Mitchell Garrell chose to do so. He indicated he would confer with his boss, District Attorney Mike Nifong, before making a decision.

IMO, the reason for a subpoena instead of the cops doing it the normal way is to try to intimidate the other players. Let them know big old Ninutso is watching.
Many thanks for the post. The evidence clearly supports the lawyers arguments: The Investigator is in deep trouble. It is difficult for me to see how if the judge reads this he will not throw the case out or at least demand objective evidence that a sexual assault actually occurred.
I'll be very upset if charges aren't brought on Nifong and those DPD officers.
It is Nifong and his investigator who are in trouble. The other officers do not appear to have played a role in any misrepresentations to the courts nor signed affidvits that are untrue.

Officers had to know, and they said nothing. They were going to let these 3 young men get railroaded.
Sgt. Shelton has known all along that CGM was a liar, and that is documented by his own report, admittedly written nearly a month after the fact.
Addison was out trashing the team relentlessly.

You may well be right , but I am responding to the consequences of the defense lawyers representations to the court.
The police are not such bad guys in this to me. They treated her claim seriously and took her to a hospital when they knew she really belonged in a rehab/drunk tank. But they did not believe her changing story and did not treat the house like a crime scene.
The police can not make Nifong stop his reelection witchhunt. They police can not make him not lie to the press or the courts. The police did not throw away their notes despite the pressure from the city manager. One young detective maybe was bullied by Nifong. But other than that one young investigator, what could any of the police have done? And remember these police officers would be the ones on the street had Nifong sparked a race riot which he very well could have.
