The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Wasn't she hauled to a facility for drunks before she claimed she was raped? Wouldn't they at least get a blood alcohol level?

A honest judge would have a HUGE problem with this:
"Information provided by driver Jarriel Johnson, including an assertion that the woman claimed to have had sex with at least four men not long before the lacrosse incident, also was omitted from Himan's official affidavit, according to lawyers Osborn and Conner."
Why wasn't this information given to the judge? Why the ommissions? This was a false presentation of the facts of the case.

This doesn't look good. It's look like everything was edited and angled to misrepresent or paint a false picture of the event.
I've lost count to how many versions we've heard. This was the first I'd seen though of how Kim was the one who returned to the house for the purse. I wonder whatever happened to the shoe!
She didn't get any treatment at that facility, I don't think. That is where she first made the gang-rape claims.
They take her there and she freaks out when they are trying to process her (she realizes what is happening - she's been there before). She claims rape and is moved to the Duke Medical center. There she is in control of her destiny. She even chose not to talk to the police anymore. She preferred the sexual assault nurses. She basicly tells the attending policemen to take a hike, leave her alone.
I believe officer Shelton said that the Medical personnel came out to him and advised him that she was now claiming rape. She was in charge at this point and she's been in the driver's seat for sometime now.
I hear you. I've seen 50 people say that. She has special priviliges in NC and Willie Gary is just waiting to come in and clean up (civilly) if her rights are broached.
I don't know how many people caught this, but if you read the Vanity Fair article where they report Kim's version, it's amazing.
The AV has always said she was new to this dancing thing. She didn't know what she was doing and that Kim was more experienced. Kim consoled her and assured her everything would be alright. The AV said that she argued with Kim because she didn't want to return to the house and Kim wanted to return and perform more (think Tips).
In the Vanity Fair article, Kim says she was new and inexperienced. She says the AV was experienced and a club dancer. She says the AV comforted her and told her she would lead the way. Kim tells Vanity Fair that the AV wanted to return to the house and that she did not.
The wheels are coming off the wagon.

That is a very impressive list. I think Kim and Crystal's statements to police also hose Nifong on the date rape drug hint.
Sounds like you got hosed. Maybe you should try writing the news papers again. Maybe they might be more interested in your story now.
To me it looks worse. It appears that the investigation, of which Nifong made himself a part, deliberately withheld exculpatory evidence as well as serious contradictions in Mangum's tall tales. I wonder who at DPD kept these notes on file? I can't believe they weren't 'lost'. Someone has to be out to get LIEfong.
I also wonder about the second DNA results that LIEfong collected himself. We know he is unethical; there is no doubt of that at this time. I'm waiting for him to spring a DNA surprise on us all this summer. I won't be surprised if he does.
Looks like Himan could be busted.

Actually, it's worse than I stated in Post 325.
If you take into account the latest developments from these Defense motions, Kim says the AV wanted to go back in (and Kim did not) BECAUSE the AV thought there was more money to be made.
Their stories are almost completely opposite. Each one stakes out the position of the new, inexperienced dancer and each portrays the other as an Old Pro. Each one says the other wanted to stay and perform more. The entire mirror opposites on these issues is uncanny.
This should be a real warning flag for a Distric Attorney, when your "Victim" and your only witness are pointing the finger at each other. Only Nifong could proceed full steam ahead with this gang.
If there were any cartoonists out there that weren't radical liberals, someone would draw a picture of Nifong with him hanging his head out of the DA's office looking forward, and have the building labeled "USS Titantic"

Very True. Add the Date rape hints by Nifong when he knew about her muscle relaxers and heavy drinking and why should Nifong be in a position of responsibility?
Great Point. Nifong has to be having nightmares of the Feds taking over his office and confiscating stuff from his home. His eyes are darting while imagining the scene on TV as he's taken out in handcuffs.
That just screams malfeasance on the part of Himan. Isn't this the kind of thing the Feds get involved in?

Nifong has no timeline. I think he's just trying to see how many arms he can twist through coersion to get those supporting the Defense timeline to shift. Nifong may just be happy by compromising the Defense timeline without proving his. I'm sure it didn't take Bissey much to change his timeline, but the media has him locked into his timeline on
video.
So, we may see, Nifong call Bissey. Bissey says the girls go in at 11:30 to support Nifong. The Defense lawyers destroy him with video from several networks. So, as with other evidence in this case, Nifong is acting like a typical defense attorney in this scenario. He's the one poking holes - reasonable doubt in the defense story, if you will.
I think the subpoena requests from a couple days ago, requests by Nifong point to where Nifong is going with the case. Every witness Nifong has contradicts the AV story on major points (including the timeline). He has a loser, unless, with the home addresses of all 47 players he has requested, investigators paying them unsuspecting visits gets one to agree to carry forth Nifong's version of events - including the timeline.
At the same time we heard the Defense was bringing in every player and getting them on record (signing affidavits) as to their account of that night - Nifong had submitted a request to the court to subpoena the home addresses of all 47 players. I think the Defense interpreted that subpoena as upcoming attempts to bring someone over. Scare a weak member into believing they are in legal jeopardy, and there's only one way out - testifying to Nifong's version of that night.
