The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

I hope you are right. The deal would have had to been made when she was arrested for her probation violation.
But having a corroberating witness that early in the case would certainly limit Nifong's legal liability. Certainly Roberts is a loose cannon and has said conflicting things after she would have had to agree to this deal. But still I wonder if Nifong would dare try this.
LOL! I've seen /sarcasm before, but not /s, although I suspected that might be what you meant.
Well, like the song says, "It's hard out there for a pimp..."
Flexeril isn't a heavy-duty narcotic. It's not a recreational drug that's subject to wide abuse and would not be difficult to get a prescription for, nor would it be a drug that someone would want to avoid using. It's just that it causes dizziness when combined with booze, which is what she did. Neither is an illegal substance, so there was no big deal in her admitting that she used it. I doubt that she didn't have a prescription for it.
What does her alleged history have to do with anything pertaining to the Flexeril? We don't know anything about her other medical history except that she was fit enough to be accepted into the Navy and that she had two kids. Flexeril is no big deal, and could easily have been prescribed for ner by a doctor for some muscle strain or back pain, any number of things. It's not a big deal in and of itself.
Via the judge's order from the last hearing on various defense motions.
I just think there's a disconnect with the life of someone selling their body and having personal drivers and the life you and I might live.
Maybe her Pimp didn't offer a good medical plan and the doctors visit and resulting presciptions were way too expensive.
We do know she has at least 3 license suspensions. Those are usually the result of someone with substance abuse issues (alcohol or drugs). From there, it's reasonable to believe she has an addictive personality. So, if she did have the medicine legally, I wouldn't bet that she was taking it as directed.
I know that it's not the type of recreational drug you usually associate; however, addicts mix and match everything and in the absence of other items. They are also desperate to numb themselves. I think the description from the Policemen at Kroger would classify as being numb.
Geraldo is saying the Defense has attacked the AV in everyway.
Geraldo - Nifong must have something else.
Then he is breaking the law Geraldo, it's illegal.
O'Reilly and Geraldo are two idiots. They don't have a clue.
Roberts is too much of a loose cannon and so is Mangum. If Nifong made such a deal with Roberts, and Mangum bails out on him, that's going to leave him with a deal with Roberts that, if he then reneged on, would send her screaming to a lawyer and the media, or else he would have to fulfill the agreement getting absolutely NOTHING in return. What you're talking about is a DA overtly subborning perjury, which is a felony, and would be most particularly stupid to do in connection with a highly flaky, known felon. It's too stupid a move, even for Nifong, and I doubt that he would try it even with a trustworthy relative. That's not to say that he wouldn't intimate to her through counsel that he could be helpful in not pushing her own criminal case to the max if she were to remain helpful and accessible in the rape case, but that's a whole other ball game. There's no criminality in that on Nifong's part, and is rather common.
I caught the tail end of BO, what is this about something that happened at a previous party?
Thanks!
I agree. I don't say she didn't abuse it by combining it with alcohol - I think she probably did. I'm just saying there's no reason for her to hide it from the SANE nurse or the doctor.
I agree she's addicted to being loaded anyway she can and is an out of control person. When stressed, she lies, runs, hides, blames others, stays high, etc.. She seesm to have addiction and avoidance issues in her personality, and is a dependent type of personality. But for her lies about these boys, I would pity her.
yeah, she did a performance for a couple and she used a foreign object (motor driven).
She also pointed at Kim as helping the players sexually assualt her (acccording to papers filed).
Geraldo just doesn't want to believe this. You have to believe Nifong wouldn't have brought this forward if this was true, Nifong MUST have something else, etc. O'Reilly let Geraldo go and neither knows this case.
In North Carolina, Nifong is REQUIRED by law to turn over everything he has. Geraldo and others are hoping and wishing for magic bullet that will cinch the guilt of the players. He cannot legally have something - some evidence or witness - without divulging it to the Defense.
The defense motions are official court documents and Nifong can reply and make them look really foolish with his responses to these motions. So, the Defense can only go so far - unless it's true that Nifong has nothing. There's no there, there.
Well this is just "Precious,"

Was this information in the 1300 pages or is there a leak in the DPD?
I wish I wouldn't have read that. Nauseating.
I think Nifong is in some legal trouble. I really do.
He went on National TV everywhere and accused these players of robbing the Victim of $400.00. Yet, there are statements that the AV said that Kim Roberts stole the money.
You cannot do that. He has an obligation, he has an allegiance to the truth.
And while he was going on TV and saying he was confident of these crimes, the Poster was printed with all the names and faces and it was distributed to an angry mob and to the media. It was, or a version of it, was posted in the paper. There is a connection to Nifong and Crimestoppers, in my opinion.. I posted it last night. It sure looks like Nifong handed the information to Crimestoppers asked them to publish and then told the media to look for it, in connection to identifying the perpetrators of the Rape at Duke.
Nifong isn't done yet, just days ago Nifong requested that the Home addresses of all the players be provided to him (Now, in June). Why? To pay them visits and put pressure on them to answer his questions without their legal reps - IMO.
Neither, probably. At the last hearing, one of the defense motions was seeking an order directing all law enforcement involved in the case to keep all notes, messages, and records pertaining to the case because it was believed that there was much not turned over to the DA (unknown at whose request they were withheld, but I have my suspicisons, lol). Now, that information may have originally been disclosed to the defense by someone inside DPD (that there was a lot or some stuff not submitted to Nifong), or the defense may have just surmised it because of the way Nifong had been behaving.
It appears to me the defense is now accessing those previously undisclosed statements, reports, messages, and notes. There are the makings of a massive civil rights suit in all this. Pressuring the DPD may smoke out somebody to rat Nifong out, which would be sweet.
I found the info here...

Apparently this latest motion is 32 pages long. Each news account that comes out offers additional details. Hopefully, the entire motion will be on line soon. In the meantime:
Highlights (or lowlights if you prefer) From CNN:
http://www.cnn.com/2006/LAW/06/08/d...tion=cnn_latest
"Pittman said in a handwritten note dated March 22 that the accuser, to whom Pittman refers as "Precious," wanted to stay at the party and earn more money, even after one of the players made a verbal threat.
"Precious became 'crazy' and eventually passed out and had to be carried to Pittman's car by some of the Duke athletes," the statement says."
"Another police note obtained by the defense says the alleged victim acknowledged having two beers before arriving at the party and that she and Pittman both had a rum and coke after their arrival. "
From the H-S:

"Also attached is a five-page handwritten statement from a Jarriel Johnson..."
From WRAL:

"Wednesday's motion also claims that the initial examination performed on the alleged victim did not reach a conclusion as to whether she was raped and that the only trace of physical trauma included a scratch on the alleged victim's knee and heel.
Osborn writes that the alleged victim said she was hit, kicked and strangled, but that the investigator in the case, Benjamin Himan, omitted that "the examining physician
at 3:14 a.m. [on March 14] found no neck, back, chest or abdominal tenderness."

It doesn't matter they will spin this as she "was traumatized" and that's why her stories have differed, that hideous lisa, gloria, the black lawyer, alan colmes. I never watch msnbc but abraham's show is really the best for coverage
I remembered the motion. I figued that this new info was probably in the stuff that Nifong didn't turn over. I'm surprised that he turned this stuff over at all. Do you think that the DPD notes, et al., came straight from the DPD or did they go through Nifong first? The motion was to compel Nifong to turn it over right? I still wonder if the police chief himself might facilitate the information getting to the defense. Either that or he is sitting in his office rocking back and forth ---see no evil, hear no evil, say no evil.
What?
