The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Well that settles it. What the 2nd striper told the cops the first time doesn't matter. What she told Nancy Grace's producer 2 months after it happened and after she got a new plea deal does. And just think, this woman like Wendy Murphy and Georgia Goslee were prosecutors. Let's see we also have other people out there like Ronnie Earl. I am totally losing faith in the legal system.

The story will continue to evolve until all the "T"s are crossed and the "I"s dotted. It will continue to grow and grow until the desired effect is achieved. In other words, if this doesn't work, how about this? I have lived it, experienced it and felt the total disbelief as the wheels of justice got stuck on stupid. There will be no one to pull out the monkeywrench, there will be no one to put the machine back on line. When something so fantastic can get legs and walk, then run, then cross the finish line, you have to ask yourself what do others know that I don't.

And because this disfunctional family is completely unaware of their daughter's activities, her penchant for sex and big adventures, they project on to the families of these young men from Duke that it's possible to have a child you can't keep tabs on and give up to a life of drunken orgies and debauchery. It doesn't happen. I knew then and know now where my son is and what he's doing and he's close to 21 now. As long as he lives under my roof, I get to know who, what and where and all the answers had better add up or he's toast. He wasn't a neglected child -- he was an only child under the microscope only an only child can tell you about. If he had been one of several, he'd still be under the same microscope. My parents raised me to be the parent they were -- and my parents were on the case, on my side, quick to censure if I stepped out of line and ready to love no matter what. Because Crystal got shortchanged in the parenthood of life means everybody did. NOT!!!
Actually I think the number of people that care are growing. This case is a outrage. It shouldn't ever get to a courtroom. There are reasons the talking heads are bringing this up. Some of them are as outraged as we are. I also think the amount of emails they are getting on this makes them try and keep this story going in the media. Yesterday Fox & Friends covered this story in the you pick part of the program. Our emails are working. If you got some info you want one of the anchors to cover, send it to them. If you are happy about how they are covering this tell them so. The more replies they get the more likely they will continue covering this story. Basically what you need to do is ask yourself what does Nifong want us to do?
It is real simple he wants us to shut up and go away.
How bad does bad have to be before someone with authority steps in? How much do the lives of these three boys have to be ruined? How many billable hours will be paid to the defense attorneys?
Sadly no one is going to step in and do anything. That is why we have to keep the noise level up and the spotlight on the people involved in this case. We can't just stop with Nifong. Tracey Cline who works for Nifong was second chair in another rape case in 2002. Jim Hardin who is now a Superior Court judge was the DA in that case. They charged Leon Brown, a black man, with rape. He voluntarily gave DNA and pubic hairs which didn't match what was in or on the victim. The victim originally told the police the guy she thought done this was her white cousin. When they found him, they found all kinds of evidence against him. At that point in time, in a effort to save his own hide he fingered Brown. The prosecution gave him total immunity from prosecution. Brown spent a full year in jail and was eventually acquitted. After the trial was over the jury foreman said this trial was a total waste of time.
As to how much this is going to cost the state and kids parents, I really hate to think about that. The impact of this farce might even be larger if the community doesn't like the results and decides to take matters in their own hands. Nifong needs to be disbarred.
If I say so myself, we have been ahead of the curve all the way.

I've been thinking the same thing. Roberts aka Pittman was ID'ed by the FA immediately. She didn't need weeks and a coached line up to identify her attacker.
Nifong said he had no doubt whatsoever that she was raped.
The father said the daughter was raped and sodomized with a broom- looks like it was probably Roberts who brandished the broom ....
I caught snippets of H&C and Greta last night. I believe that I heard Kimberley Guilfoyle say that if what we now know is true, Nifong should be recalled and disbarred.
One of the panelists on Greta said that a federal grand jury should immediately begin investigating Nifong for obstruction of justice.
Unfortunately, as you well know, it appears as if the NC legal system is content to allow another dirty DA to sully all of their reputations.
Now you are going to make me cry, LOL.
I mean that in a good way. Your family and Mike Nifong have been to hell and back and yet instead of sitting back and saying "Thank God it is not us this time" you made a comittment to take a stand.
At least with my son, I had some control. I cannot imagine being caught up in a mess that threatened to destroy me regardless of what I did. I cannotimagine events taking total and complete control of my life.
