Lawyers representing one of three Duke University lacrosse players charged with rape want details about any toxicology tests performed on the accuser, asking in a motion filed Monday whether such evidence even exists.
"No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week. The attorneys represent Reade Seligmann, one of three lacrosse players charged with raping a woman hired to perform as a stripper at a March 13 team party.
Seligmann's attorneys want a judge to order prosecutors to provide any reports "generated from blood, urine or other biological samples" collected from the accuser. In the motion, they cited a story published in Newsweek earlier this month that said District Attorney Mike Nifong "hinted" such tests would reveal the presence of a date-rape drug.
Authorities have said a doctor and specially trained nurse performed a physical exam on the accuser that found evidence of sexual assault. But the nurse who filled out a report on that exam indicted no toxicology tests were performed, according to the defense motion.
Nifong declined to comment.

It's pretty simple. I believe a SANE is like anyone else, capable of making mistakes, making mistakes of judgment, and just plain letting bias play a role.

AFAIK, he still hasn't examined the accuser's cell phone. It was the first thing seized over 2 months ago!
At this point, NiFong might THINK he knows what the time frame should is but I am absolutely certain that ALL the pictures were released to the press.
NiFong has yet to place ALL 3 BOYS in the bathroom at the same time within an extremely narrow time frame. (Watch for Crystal's time statement to be changed to "it seemed liked 30 minutes"...it seemed like a lifetime".
It's probably why nothing comes out from the prosecutors regarding time.

I know this case pretty well. It sounds a lot like the Duke case, with the races reversed. The Sundary Morning murder had black cops framing a black teenager.
I do hope there is GPS data attached to the Phone call. It is terribly accurate right now. My little $300 Garmin hand unit logged 20 feet difference from a $25,000 unit.

Apparently Nifong has let it be known he is not happy with the Hannity & Colmes show. Megyn alluded to it yeterday, and the guest defense attorney on the panel (not Pirro) said the same thing.
Sean brings up the issue of prosecutorial misconduct, Megyn seemed receptive to the idea (my take), but didn't outright say there was.

Yes, she tried to get them to give her CGM's address while CGM was passed out in her car at 610. From the N & O:

Because there was a warrant for her arrest, Roberts told police she picked up the woman on the road, in a crowd of men yelling racial slurs. Police did not ask her name, and Roberts went home."

Of course O'Reilly is not mentioning him cheering for Geraldo when Geraldo predicted on his show that the white boys would run to the DA and cut deals a day or two after the indictment: because they are soft and white.
O'Reilly did not have concerns early on that the Prosecutor may have been cherry picking information he handed out to the media or was lying to the media.
For example, if the defense had communicated to Nifong that they had ironclad evidence that the particular suspect was in another city on the night in question, and Nifong refused to even listen to what their evidence might be, that would clearly be probative of prosecutorial misconduct
What if the DA simply refuses to hear any evidence, i.e. where suspects might have been, or how it would be impossible for them to have committed the crime for any reason? I guess I'm so astounded the boys were indicted solely on the AV's word with little to no investigation and no interrogations. Supposing she was raped and she's picked the wrong guys; the DA's actions will have enabled guilty parties to go free.
I personally don't think a rape took place, but the DA's rush to indict may have eliminated any chance of justice if CGM had been raped.
If she was raped, chances are the rapists will go free. If she wasn't raped 3 college men have been unjustly indicted. Both situations could have been avoided and I believe the DA abused his power to get us to this point. Somehow he should be held accountable imo. I've never thought so little of the legal process. I never believed the old "you can indict a ham sandwich." I guess you can.
