Lawyers representing one of three Duke University lacrosse players charged with rape want details about any toxicology tests performed on the accuser, asking in a motion filed Monday whether such evidence even exists.
"No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week. The attorneys represent Reade Seligmann, one of three lacrosse players charged with raping a woman hired to perform as a stripper at a March 13 team party.
Seligmann's attorneys want a judge to order prosecutors to provide any reports "generated from blood, urine or other biological samples" collected from the accuser. In the motion, they cited a story published in Newsweek earlier this month that said District Attorney Mike Nifong "hinted" such tests would reveal the presence of a date-rape drug.
Authorities have said a doctor and specially trained nurse performed a physical exam on the accuser that found evidence of sexual assault. But the nurse who filled out a report on that exam indicted no toxicology tests were performed, according to the defense motion.
Nifong declined to comment.

Crystals not a techy. NiFong TOTALLY avoided anything related to technology (like the time stamped photos) for the indictment. He made it all about the SANE report and Crystal's "WORD".
I hope both NiFong and Crystal wind up in jail.

I am holding out hope that lots of people file suit against Nifong for malicious prosecution. An attorney on FNC said anyone could file; even viewers!
Looks like Nithong figured out Bob Bennet's strategery: drip, drip, drip the evidence against Nithong out until he is totally discredited by trial time. BUT IT'S TOO LATE!!

Well I hope they drip some more before Nifong's friend in a black rope gags them. I mean, he wouldn't move this case forward in quicker than 2007 so you know he is inclined to help out a fellow elected official.

Yeah, Colmes was brow beating the poor lacrosse guy. We of course know what the DA has via the leaked discovery. If Nifong has more, he unethically gave it to the defense.
Lt. Governor Andre Bauer has crashed his plane near the North Carolina border, at a rural airport in Blacksburg. A spokesman for Bauer's office, Dave Lucas, says the 37-year-old lieutenant governor suffered injuries to his arm and leg and is in good condition at Greenville Memorial Hospital. Nifong hasn't leant the meaning of chutzpah yet.
Jack did survive a couple of crash landings that true...maybe I was going w/ the LOST theme but maybe it's 24 instead, maybe he is an secret agent and the Lt. Gov is his cover.
Hoping it's a group of NC heavyweight attorneys. Even better would be someone from the Durham DA's office.
I think he was coming in to NC in a small plane to wrest control of the state from the evil Mike Nifong. Nifong has been acting strange lately and Bauer thinks he is being controlled by a Chinese syndicate who, unfamiliar with laws in the US, are forcing the easily corruptable Nifong to discredit the son of a K-street attorney who is owed a favor by the president. Kim, acting as a double agent, has infiltrated the communist cabal.

It depends on the drug, though. Date-rape drugs - "roofies" - would not be detectable at this point in blood, urine, what have you, and even if they were, it's been too long to pinpoint an exact date and time it was taken. Too little too late, as they say.
