Lawyers representing one of three Duke University lacrosse players charged with rape want details about any toxicology tests performed on the accuser, asking in a motion filed Monday whether such evidence even exists.
"No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week. The attorneys represent Reade Seligmann, one of three lacrosse players charged with raping a woman hired to perform as a stripper at a March 13 team party.
Seligmann's attorneys want a judge to order prosecutors to provide any reports "generated from blood, urine or other biological samples" collected from the accuser. In the motion, they cited a story published in Newsweek earlier this month that said District Attorney Mike Nifong "hinted" such tests would reveal the presence of a date-rape drug.
Authorities have said a doctor and specially trained nurse performed a physical exam on the accuser that found evidence of sexual assault. But the nurse who filled out a report on that exam indicted no toxicology tests were performed, according to the defense motion.
Nifong declined to comment.

Nifong thought he needed to at least pursue the case to appease the AA community but knew that the case would fall apart in the end due of lack of evidence...he will get re-elected and look like the good guy.....he might get the boot instead....

Good point, OldFriend. There has GOT to be some recourse for innocent people who are charged on such non-existent "evidence".
The stripper was asked who might have left DNA in her and she named two drivers and her boyfriend? When was she asked this?

The lawyers on TV are finally turning on Nifong with a vengeance. All four of them on Greta, plus Greta herself, were calling for Nifong to either come up with something or else come out and exonerate these young men.
I think he's going to have to, or these young men and their lawyers will take the city of Durham to the cleaners, and Nifong will be held responsible.

My question is, have they sought DNA evidence from any of these people....or can the defense do it?

The above is the BLEAT Jane-America was given time after ad nauseum time. No questions asked, no looking for evidence, no wondering -- just that "women never lie" and women never "lie about being raped". As I've said before... the so-called experts and this false accuser are the ones who make a mockery of rape.
I'd like to see a line-up of the Duke Academics ... right fast. grr. They should be booted from teaching -- certainly in the state of NC. They've made a mockery of "higher education".
BTW, one of the local stations (NBC I believe) covered a story about a quadruple homicide in Durham. Talked to the family of one of the victims, very nice folks it seemed. They were more than a little upset about the fact so much has been done about this case and hardly anything about their son's case
Similar. But this "case" was really, really bad and because it was INTERNATIONAL news. Cases like these are happening throughout the system.. but like that old axiom.. if a tree falls in the forest..
