Duke rape case set for 2007

DURHAM, N.C.—One of three Duke University lacrosse players charged with rape wants the case resolved in time for the next school year, his lawyer said in court yesterday. But the judge warned he will not fast-track the proceedings.

The case "is not going to jump ahead of the line and be handled any differently," Superior Court Judge Ronald L. Stephens said at a hearing for sophomore Reade Seligmann.

After the brief hearing, District Attorney Mike Nifong said he does not expect any trial to begin before next year.

As someone pointed out earlier, two of the expert witnesses listed by Nifong are medical personnel at Duke, and based on their resumes which were dug up on the net, are the people who did the exam. The nurse's undergraduate major was "women's studies". Wanna' bet she was a "sympathetic" examiner.

Yeah, the date-rape drug story just popped up all of a sudden. I wonder where it originated? Nifong or Kim? Did Nifong's hint put ideas into Kim's head? Vice Versa?

Here's an April 18 Newsweek article that says Nifong hinted several weeks before about the date rape drug. Since the first DNA results were released April 10, I bet Nifong had been told the results by the SBI days before and starting floating this "date rape drug hint" to offset the "no DNA match" news to com.

His May 2 primary win depended on keeping his promise to make some arrests, which he did with his April 17 indicting of Seligmann and Finnerty (both ID'd on April 4).

Thanks for the ping. This is another huge breaking point--no date rape drug (not that they could have proved lacrosse players administered it). Last week we learned the AV claimed NO condoms were used. Where is the MSM? These are Nifong back breakers IMO.

Kim's sudden recollection that the accuser "changed" during the party came right after she was arrested for a previous probation violation.

"Where is the MSM? These are Nifong back breakers IMO."

And he has known about them both for quite a while, and spoken about them to the contrary.

You say something about spiked drinks at the party, and I'll go easy on you.

I just emailed the WRAL reporterette. It'll be interesting to see what she says...

Ms. Buscher,

On May 11, you reported that tests had been made to detect the presence of a date rapd drug in the complaining witness:

Alleged Victim Was Tested At Hospital For Date-Rape Drug

POSTED: 6:20 am EDT May 11, 2006
UPDATED: 10:32 pm EDT May 11, 2006

DURHAM, N.C. -- An exotic dancer who says she was gang-raped and beaten at a Duke lacrosse team party where she was hired to perform was given a test at a hospital to determine if she had a date-rape drug in her system, WRAL has learned.

The accuser, a 27-year-old single mother and student at North Carolina Central University, was treated shortly after the alleged attack on the morning of March 14 at Duke University Medical Center, according to court documents.

Legal experts said such a test is often performed at the request of a police officer. The results of that test, however, have not been made public.

Today WTVD Durham reported this story:

http://abclocal.go.com/wtvd/story?section=triangle&id=4194520

(05/22/06 - DURHAM) - There are new developments in the Duke lacrosse rape investigation. Defense lawyers say they didn't get everything they wanted, when a box full of evidence was handed over.

In particular they're asking for a toxicology report that might have been performed on the accuser the night she was allegedly raped.

Last week, Nifong handed over the evidence in his case against Duke lacrosse player Reade Seligmann. That evidence included almost 1,300 pages, two VHS tapes and a CD ROM with photos on it.

In two motions filed by Defense Attorney, Kirk Osborn, we're learning what was not included in that evidence.

Osborn is asking for any and all toxicology reports from tests done on the accuser when she was examined at Duke University Hospital the night of the alleged rape.

Osborn cites a Newsweek article in which Nifong, "hinted that blood and urine tests of the accuser would reveal the presence of a date-rape drug" as the basis for his request.

Former prosecutor, Karl Knudsen say toxicology results can be back within hours and says it's strange that a test that would've been done two months ago isn't included in the evidence.

Knudson says we can't know from the motion whether a toxicology test was definitely conducted on the accuser, but he says the motion isn't good news for the district attorney's case. "Either way you look at it, either it didn't exist and it was irresponsible to even hint at it, or it does exists and it hasn't been closed, and it would seem to me that's as problematic too."

Defense attorneys have said the accuser was intoxicated when she arrived at the Buchanan Boulevard party.

The so-called second dancer, Kim Roberts, has said the accuser didn't appear drunk when she arrived, but stumbled as she left.

Defense attorneys are also requesting complete cell phone records from the accuser's cell phone.

So was a tox test done? Or has Nifong lied?

Well done abb!

No condoms-Nifong lied

No date rape drug-Nifong lied

First DNA MUST have showed boyfriend's semen in SBI test--Nifong didn't disclose?

Shouldn't there be grounds for prosecutorial misconduct here? Or does NC not have laws against that either?

I will be surprised if you get a reply that is in any way informative. This flies in the face of the agenda of the news media. It will be hard for one of them to acknowledge that there are lies floating around from the false accuser and her backers.

"does show that there was DNA material from multiple different people on one plastic fingernail, and that in that material was some of the same characteristics as the genetic material taken from some of the Duke lacrosse players."

More questions: Who are the OTHER people? Were they at the party? Did she get this other DNA BEFORE the party?

Shouldn't there be grounds for prosecutorial misconduct here?

Which leads me to this question:

Is there a line, a point, a specific action which will get the attention of someone? State Police? FBI? Justice Dept?

How bad does bad have to be?

Excellent question.

If something isn't done here, the floodgates for false accusations will be opened. (imo)

Nifong can delay the trial until 2007, and I guess there's nothing that can be done about it. However, I hope that he cannot also refuse to release pertinent documents to the defense until 2007!

Good job!

I have been re-reading those reports about a supposed date rape drug. All of them seem to mention or hint at the tests that were done, the implication being that the results will not be favorable for the LAX players.

Now we have magical disappearing toxicology reports to add to the list of weird stuff in this "case".
