Did you see Nifong's face-the smart-a**smile when Seligmann's attorney said he had an air tight alibi?

I think what ever Nifong has, it has something to do with timing. Maybe he's going to claim that the strippers left and then came back-and that's when it happened...

Can't they subpoena the phone records? When you get a bill, you get a record of all the calls you made that month. The battery dying should make a difference.

Anybody that believes their record is ever truly "expunged" are being lied to.

Not quite being lied to. Most places I think they are told they only get on diversion. So that means someone must keep track of your diversion.

Of course, if the diversion goes on, you are not convicted nor did you plead guilty. So the charge is on your record. The disposition is diversion, I guess. [I know this from watching college sports teams were players from time to time get in minor scrapes and with the second minor scrape diversion is out of the question at least in FL.]

Summer has arrived here, and cats no longer sleep on the monitor. They are vying for space on the keyboard. I'm thinking of patenting a cat bed that resembles a keyboard. Perhaps it could have a functional keyboard underneath.

I can't say that all the potential information is saved by the billing system.

Can't you? You ever get a cell phone bill? They usually read like telephone books, nary a call made, even if its for 1 second, is omitted.

What is stored locally would be a phone directory and the actual text messages, perhaps, but that would be erased only if the "hard drive" was removed, I believe, not a "dead battery"

Panelist on Abrams: Ed West, says Judge Stevens will not let things get out of control in his courtroom and that nayone causing trouble will be put in jail right now.

Abrams: Defense arguing about more than discovery. Defense seemed to be saying "Judge, you know this is a terrible case being brought by the prosecutors and as a result, we want you to treat this case differently."

Yale: You're right. Defense said we want this case to trial as soon as possible. Osbon also said we have an airtight alibi. Judge said I'm not oging to order discovery that is usually turned over voluntarily.

Heck, the defense should be able to get them from the CIA/NSA, if what the media has been telling us for the last week is true.

Exactly....I was just going to suggest that they subponea the call records from the phone service..
