Good question. But I am cynical enough about Nifong and his MO as to think it possible that that finding could have been on the last page of the report, and Nifong 'forgot' to include it to the defense.

I'm thinking more in the line with NiFong excluded the sample under the "prior sexual behavior" rule.....except it wouldn't apply in this case.

He'll be disbarred. The DA's job is not the same as an ordinary attorney in a case.
