I haven't heard anyone explain away the injuries and behavior the rape nurse said were consistent with rape. The behavior could be explained away by this woman being a nut, but where did the injuries come from? Could they be self-inflicted?
They could be self-inflicted. She could have had a job before the Duke Party and someone drove her to the Duke House. Was that man her boyfriend, as many beleive?
BUT, the biggest thing is that the SANE nurse may have said the injuries are consistent with rape - AND the injuries could've been blown out of proportion (no one has seen the report). Many, Many lawyers contend that the physical condition of the genital area that SANE nurses ID as consistent with Rape is also consistent with CONSENSUAL Sex.
Also, except for extreme cases (this woman did NOT spend much time in the hospital) - SANE nurses can't differeniate whether the tears were inflicted 3 hours or 30 hours ago.
We don't know that she had injuries consistent with rape, only that someone who works as a SANE claims she did. Unfortunately, many who are drawn to such fields invariably let their bias get in the way of their work.
If a woman claims she was raped, the SANE knows the pressure is on her to find evidence consistent with rape - which really doesn't mean a lot, since most sex can result in enough friction to produce "evidence consistent with rape."
There is no evidence to support her claim that she was raped, so it's highly probable that the SANE nurse is wrong, and why not? She's just a person, and they make mistakes or follow their biases.

Physical conditions consistent with rape are also consistent with consensual sex, rough consensual sex, and acts of prostitution.
