Alleged Rape Victim Admits Making Up Story Woman Charged With Filing False Report
NEWBERG, Ore. -- A woman who claimed that she was raped after parking her car outside a Newberg apartment complex now admits to making up the story.
The woman said she parked along South Everest Road when a man pushed her back in the car and raped her. She said she was visiting someone at the Canyon Ridge Apartments.
"It's very alarming. Most often when officers are investigating a sexual assault, the victim knows her attacker," Newberg Police Department spokeswoman Julie Carrasco told KOIN News 6 at the time.
But the woman now says the attack never happened. She is charged with filing a false police report.
I think the defense can get it in.
I'd like to see a study done on how many SANE nurses and rape kits support a rape claim for cases in which the claim turns out to be admittedly false.
Two Highly respected forensic Doctors said SANE nurses can't tell if the damage was done 3 hours or 30 hours ago - except in extreme cases (and in that case she would've been in the hospital longer than several hours).
So, the Injuries ID'd by the SANE nurse cannot be directly tied to the DUKE party.
Two High Powered, respected Defense lawyers on National TV said that SANE nurse "consistencies" also mean "consistent" with consensual sex.
Lawyers stick together. They usually have to be angry about a personal matter before they will take action against another lawyer. If the dispute is about a case or personal conduct, he has to be exceptionally egregious and unethical before a lawyer will act against another lawyer.
Is this a surprise when one third of all DNA tests show women lie about who is the father of a child?
Absolutely True. But, if I was paying exorbitantly high Legal fees and the DA had refused to look at exculpatory evidence and broke ethics rules in attempted Questioning and broke their own guidelines in the Lineup.... I'd be highly upset with my legal representation.
But, business is good in Durham for DEF lawyers - maybe she doesn't care.
I doubt it. Motive plays a large role in such scenarios. Rape is a great excuse for someone trying to explain their appearance (or dissappearance) for a tryst to a partner.

I'd be interesting in the statistical likelyhood of being beat and gang-raped by 3 men twice by the age of 27.

BEAVERTON -- A municipal judge found a 19-year-old woman guilty Friday of filing a false police report after she said she was raped by THREE YOUNG MEN.
Even though the woman never said she lied or recanted her story, city prosecutors say they took the unusual step of filing charges against her because of the seriousness of her accusations.
The woman's attorney and advocates for rape victims say the prosecution sets a dangerous precedent and could discourage others from reporting sexual assaults. .......
.After a day-and-a-half trial, Municipal Judge Peter A. Ackerman on Friday convicted the woman of filing a false police report, a class-C misdemeanor. Ackerman explained his decision, saying there were many inconsistencies in the stories of the four, but that he found the young men to be more credible. He also said he relied on the testimony of a Beaverton police detective and the woman's friends who said she did not act traumatized in the days following the incident.....
.The city prosecuted a similar case a year ago in which a judge ordered the woman to pay $1,100 in restitution for the city's investigation costs, said Officer Paul Wandell, a Beaverton Police Department spokesman.
The bottom line, Naemura said, is that people can't use the criminal justice system to further their own ends.

ORLANDO, Fla. -- The Orange County Sheriff's Office just announced that it has arrested the woman who claimed she was raped by several men who work at Walt Disney World. They say the woman made up the story, and that the sex was consensual.
The woman, Elizabeth Sunde, 26, is being charged with making a false police report, WESH NewsChannel 2 reported.
On Feb. 26, police responded to a report of an alleged sexual battery involving multiple suspects.
Sunde told investigators that she was approached by five or six "French men" in her apartment complex at approximately 4 a.m., and said the men physically carried her to the Gables Commons Apartments, where she was held down and sexually battered by at least four men.

Sunde stated she returned to her apartment some time after 5 a.m. after the alleged assaults and ultimately went to work. She did not report the incident to the Sheriff's Office until about 5 p.m., when she returned to her apartment after her work day.
Orange County Sex Crimes Investigator Detective Phillip Graves has determined that Sunde's account of the incident was not factual and that the sexual encounters were, in fact, consensual. The suspects in the alleged attacks were cooperative with the investigation from its onset to the point of providing a video tape of the incident, which helped corroborate their account of the incident.

Police charge woman who falsely accused Cowboys
DALLAS (AP) - A former stripper who made up a GANG-RAPE accusation against Dallas Cowboys stars Erik Williams and Michael Irvin was charged Tuesday with filing a false police report.
Nina Shahravan, 23, could face six months in jail and a $2,000 fine if convicted of the misdemeanor. A warrant was issued for her arrest, but police said she wouldn't necessarily be arrested at her home.
''I think she'll be afforded an opportunity to go to the county and post bond,'' said police spokesman Ed Spencer.
Shahravan filed a police report Dec. 30 - after first going to a television reporter - accusing Irvin of holding a gun to her head while Williams and a third man, who was never identified, raped her in Williams' home. She also accused Irvin of videotaping the attack.
Friday, after she was confronted with evidence that Irvin could NOT have been at Williams' house the night of the alleged attack, Shahravan signed a statement admitting her story was a lie....
"I believe very strongly that this woman has set back the issue of sexual assault victims 100 years,'' West said....

I actually remember Nancy Grace, when the reports of the video surfaced, saying Predicting they had videotaped their "crime" and she said, you know, you hear all the how stupid criminals are.. and sick.

False Rape Accusations May Be More Common Than Thought

For a long time, I have been bothered by the elusiveness of figures on the prevalence of false accusations of sexual assault. The crime of 'bearing false witness' is rarely tracked or punished, and the context in which it is usually raised is highly politicized.
Politically correct feminists claim false rape accusations are rare and account for only 2 percent of all reports. Men's rights sites point to research that places the rate as high as 41 percent. These are wildly disparate figures that cannot be reconciled.
This week I stumbled over a passage in a 1996 study published by the U.S. Department of Justice: Convicted by Juries, Exonerated by Science: Case Studies in the Use of DNA Evidence to Establish Innocence After Trial.
The study documents 28 cases which, "with the exception of one young man of limited mental capacity who pleaded guilty," consist of individuals who were convicted by juries and, then, later exonerated by DNA tests.

The passage that riveted my attention was a quote from Peter Neufeld and Barry C. Scheck, prominent criminal attorneys and co-founders of the Innocence Project that seeks to release those falsely imprisoned.
They stated, "Every year since 1989, in about 25 percent of the sexual assault cases referred to the FBI where results could be obtained, the primary suspect has been excluded by forensic DNA testing. Specifically, FBI officials report that out of roughly 10,000 sexual assault cases since 1989, about 2,000 tests have been inconclusive, about 2,000 tests have excluded the primary suspect, and about 6,000 have "matched" or included the primary suspect."
The authors continued, "these percentages have remained constant for 7 years, and the National Institute of Justice's informal survey of private laboratories reveals a strikingly similar 26 percent exclusion rate."
If the foregoing results can be extrapolated, then the rate of false reports is roughly between 20 (if DNA excludes an accused) to 40 percent (if inconclusive DNA is added). The relatively low estimate of 25 to 26 percent is probably accurate, especially since it is supported by other sources.
