Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
However, don't blame those who, like JustaCowgirl, have never been to Durham; blame the citizens of Durham for electing an out-of-control DA.
"Durham to have much less "attitude" than the blacks here in CA."
One interesting thing about Durham, several years ago it was pointed out as a place w/ great race relations, Durham was compared with Detroit, it was said that Detroit had 10 times more blacks than Durham (by population), but Durham had 10 times more Black entrepreneurs than Detroit had.

This could not have happened at a worse time. Acceptance letters were out and students were to have sent in their checks right while this disaster was playing out.
Duke's president has made it abundantly clear. He does NOT support his students. He should be fired!

Nifong, a prosecutor for 30 years, knew what he was getting into. He is seeking election to the job, and according to his campaign's Web site, has tried scores of homicide cases. That means he has dealt with evidence of man's inhumanity toward man -- and woman -- for three decades.
He should be smug, he basically has demonstrated some of the most disgraceful unethical behavior I have ever seen, and all against what I think are innocent men.
Guess what?
The democrat voters of Durham just said,"we like it."

My advice to anyone who has the ABILITY to be accepted to Duke, grab the chance! BUT! Be prepared to work hard. No "passes" at Duke just for getting in. You have to EARN that degree. IMO, those who choose not to go don't belong there. If you're not ready to challenge yourself, fo-get-aboud-it! Say, LJ, why all the Duke hate? Are you from Maryland or just the recipient of a rejection letter? Or maybe your baby received the letter.....?

As I said in my post, this could not have happened at a worse time. It has bound to have an adverse effect on all the efforts of the admissions office and the athletic department.
Duke hate? Hardly. It's hurting Duke.
Just like Nifong won tonight after his outrageous and unethical behavior - He will win this case against the LAX players if it's heard in Durham. I've been saying this all along. They will ignore the evidence and convict within an hour (wasn't O.J. like that?)
After Nifong won, Great had him on. Although, I didn't see the entire interview of him on Greta (Fox) tonight, I couldn't believe the jovial atmosphere on the show after he was reelected.
The 3 obvious Questions for Greta to ask Nifong (and you better believe had these been black players, she'd have asked):
1: Why did you send investigators to interview these, in some cases, 18 year old boys, when you knew they had legal representation? Wasn't that an end run that skirted the law?
2: Why did your office violate its own rules in the photo lineup? One of the investigators has said he was directed by you to do this. I find that strange, don't you think your case would be stronger if the AV had picked them out of a conventional photo lineup with fillers?
3: Why weren't you willing to look at the Defense's evidence when they asked to meet with you and had informed you that there's evidence that their client COULD NOT HAVE committed the crime? I don't know of any other case where a DA has declined to see evidence from the other side. Why didn't you want to see their 'exculpatory' evidence?
A DAs job is to seek the truth, correct?
I didn't see all of the Greta's interview, but the part I did see did not reflect the totally unfair and potentially illegal way Nifong has handled this entire case!
It's not hurting Duke if the parents have any intelligence. Unless your child has been accepted by Harvard or Princeton (and they like the cold: mine didn't, those summers with Nana in Florida probably had something to do with my students choice) - I cannot imagine discounting Duke. I suppose I trust that people with intelligence do not live by the media spin - either right or left spin - but look at the reality. In reality, most college students have little or no connection (unless in a community service way) with the communities in which they live.
I kind of get the impression that the people of Durham are the ones who hate Duke.
