Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
You are probably right, I was just thinking of the irony, given this horrible situation.
Obviously AV's car was elsewhere that night, since daddy said she "dropped it off." Is that correct? If it is, then where was it? Was she dropped off at Buchanan because she was in no shape to drive?
Does anyone know what the Kroger Security Guard said, did she say how long they were in the parking, trying to talk CGM out of the car? Also how long does it take to get from the house to Kroger? there is 29 mins+ between the 911 calls.

Yes, I guess I just assumed she would have driven herself to the gig if she had her car (Kim did). Since the team members said she arrived drunk, I thought that could possibly explain why she was dropped off. However, if the deal is that she is driven to gigs and picked up by whomever so that they can get their cut, then I understand. Still missing pieces, though, imo. Also, I still would like to know how long swelling/bruises take to show for the type of beating that alledgedly took place.

One of the recent defense filings says the accuser was dropped off by a male. Also, they asked for her phone records, so they may not know everything about her whereabouts that day. According to her forked-tongued dad, the accuser called him for directions enroute to the party and said as "they" arrived, "Oh, we're here." If true, which I doubt, that call would show about when she arrived.
The odd thing is that Nifong has had both Crystal and Kim's phone logs for weeks. It will be interesting to know how he followed up on what they reveal.

maybe the were in the parking lot the whole time, Kim was trying to get her out of the car, say for 15 minutes, then the Security Guard came over to investigate, and tried to get her out for 10 minutes? seems like a lot of time....

How weird is that? Calling Daddy to get directions to your strip job....... Makes one wonder.

He only came up with that story because the defense had just publicly stated she arrived at the house "seriously impaired". He was countering that premise. Unfortunately, his penchant for contradicting himself and his wife makes anything he's said questionable.
Unlike members of the media, strippers don't harbor any illusions about the chararcter of other strippers. No way she wanted CM in her home.
Now, if you mean Mangum's home, I suppose since she was passed out and her purse was back at the house on Buchanon, Roberts had no way of knowing Mangum's address.
Are you sure he, himself, actually went down there? I remember that he was going to go, but didn't. He did say he would pay for her college, and that was at the point when he decided not to actually go there. He said Rainbow Push would pay the tuition even it it turned out to be a false claim.
It depends on the vote disparity. If it's close, she can ask for a recount, I would think, just to be sure there were no errors. Asking for a recount should not be characterized as a "Gore", because mistakes in vote tallying are common. If I lost in a race this close, I would want the election scrutinized. There is nothing foolish or presumptuous aboout that, nor does it reach anywhere near the extreme level to which Gore took the '00 election counting.
Your response prompted me to do a wee bit of research, since I asked this question before. xo said it was an open primary. Actually, NC practices a modified open primary in which Independents can vote in either primary.
The reason I wondered about this in the first place was because it seemed odd to me that Nifong held back on going public on this case for at least two weeks, then he went full throttle. I speculated he did this because he didn't want Republicans to re-register as Dems to vote him out for this lynching he has undertaken. I wondered if there was a cut-off date for registering a party change around the time prior to Nifong going public about the case.
I disagree. I have never seen nor heard of this level of animosity and malice from the citizenry against a fine university. It sure isn't present at Cal Tech, Stanford, UC Davis, UM Ann Arbor or UC Berkeley.
I think what we're seeing in Durham is the exception, not the rule.
