Duke Lacrosse Accuser Made Previous Report

The woman who says she was raped by three members of Duke's lacrosse team also told police 10 years ago she was raped by three men, filing a 1996 complaint claiming she had been assaulted three years earlier when she was 14.

Authorities in nearby Creedmoor said Thursday that none of the men named in the decade-old report was ever charged but they didn't have details why.

A phone number for the accuser has been disconnected and her family declined to comment to The Associated Press. But relatives told Essence magazine in an online story this week that the woman declined to pursue the case out of fear for her safety.

The existence of the report surprised defense attorneys, one of whom has sought information about the accuser's past for use in attacking her credibility.

"That's the very first I've heard of that," said Bill Cotter, the attorney for indicted lacrosse player Collin Finnerty, who along with fellow Duke sophomore Reade Seligmann is charged with first-degree rape, kidnapping and sexual assault. He declined additional comment.

Attorneys for Seligmann asked the court this week to order the state to turn over the accuser's medical, legal and education records, and hold a pretrial hearing to "determine if the complaining witness is even credible enough to provide reliable testimony."

The accuser, a 27-year-old student at North Carolina Central University in Durham, told police she was hired to perform as a stripper at a March 13 party, where she was raped by three men.

According to the Creedmoor police report in August 1996, when the woman was 18, she told officers she was raped and beaten by three men "for a continual time" in 1993, when she was 14. She told police she was attacked at an "unspecified location" on a street in Creedmoor, a town 15 miles northeast of Durham.

The report lists the names of the three men, but no other details. Creedmoor police Chief Ted Pollard said Thursday he had no recollection of the report, and his staff has been unable to find any additional information about it.

Durham police Officer Brian Bishop, who interviewed the accuser in 1996 while working on the Creedmoor force, said Thursday he had a vague recollection of the report but couldn't remember any details.

When asked about the accuser's previous report of rape, Durham County District Attorney Mike Nifong declined to comment.

Before Seligmann and Finnerty were indicted, attorneys for the players pointed to the accuser's criminal history when answering questions about their clients' legal troubles. The woman pleaded guilty to several misdemeanors in 2002.

Believing what you see in the press hasn't proved to be the best way to make decisions or form opinions in the last few decade.

On the contrary, many of us here were able to pull together independent bits of information from various press sources to conclude, early on, that the accusations Kate Faber made of rape against Kobe Bryant were, in fact, consensual sex.

Turns out, Kate had bipolar problems, and had sandwiched Kobe in between two other men, with whom she had consensual sex within 12 hours on either side of her encounter with Bryant.

This case has plenty of information available to conclude that there is no truth whatsoever to what Crystal Mangum is alleging.

Wouldn't it be traumatic to a young lady in the peak of her prime to be kidnapped by three young studs, hauled off to a town 25 miles away and nothing happened-nothing at all, not even a demand for ransom from her family?

The cab driver "inconsistency" on the color of the car AV got into is not a convincing inconsistency at all - eyewitness reports are notoriously inaccurate with respect to details - it would not be unusual for an eyewitness even to say a car was white when it was black.

So the "gotcha" moment on the cab driver falls flat. Someone should tell that girl to get some reality, she is WAY out there. Her happy crowing makes her look like a fool.

Actually, I am sure that the moms of the accused are, in fact, getting all over their sons' cases. That doesn't mean that the moms should go on national TV to say how horrible their sons are. However, they are young men in college with their testosterone and hormones running wild. That's what young men in college do. Colleges and universities aren't called party houses for nothing. Get used to the idea. You'll sleep much better.

Amen to that.

I have said all along that this case should not be tried in the media because there is no filter for the quality of the information bandied about. I think the laws that shield the accuser's identity from being released should also apply to the accused. I am ashamed as a prosecutor that the DA was the one who started trying the case in the media. He should never have commented. The names of the accused should have remained sealed so the jury pool would not be tainted. The University should have made clear whether they disciplined the team because they had a stripper on University property or because of the rape allegation.

However, now it is out there, and what came out in the news media may end up being all the trial the accused ever get. That is sad, because what we got from the media is not very likely to be the whole truth and much of it is probably outright false.

And yet, I am as active on this thread as anyone except maybe Howlin and Locomotive Breath. I suppose I should be ashamed of myself.
