Duke Lacrosse Accuser Made Previous Report

The woman who says she was raped by three members of Duke's lacrosse team also told police 10 years ago she was raped by three men, filing a 1996 complaint claiming she had been assaulted three years earlier when she was 14.

Authorities in nearby Creedmoor said Thursday that none of the men named in the decade-old report was ever charged but they didn't have details why.

A phone number for the accuser has been disconnected and her family declined to comment to The Associated Press. But relatives told Essence magazine in an online story this week that the woman declined to pursue the case out of fear for her safety.

The existence of the report surprised defense attorneys, one of whom has sought information about the accuser's past for use in attacking her credibility.

"That's the very first I've heard of that," said Bill Cotter, the attorney for indicted lacrosse player Collin Finnerty, who along with fellow Duke sophomore Reade Seligmann is charged with first-degree rape, kidnapping and sexual assault. He declined additional comment.

Attorneys for Seligmann asked the court this week to order the state to turn over the accuser's medical, legal and education records, and hold a pretrial hearing to "determine if the complaining witness is even credible enough to provide reliable testimony."

The accuser, a 27-year-old student at North Carolina Central University in Durham, told police she was hired to perform as a stripper at a March 13 party, where she was raped by three men.

According to the Creedmoor police report in August 1996, when the woman was 18, she told officers she was raped and beaten by three men "for a continual time" in 1993, when she was 14. She told police she was attacked at an "unspecified location" on a street in Creedmoor, a town 15 miles northeast of Durham.

The report lists the names of the three men, but no other details. Creedmoor police Chief Ted Pollard said Thursday he had no recollection of the report, and his staff has been unable to find any additional information about it.

Durham police Officer Brian Bishop, who interviewed the accuser in 1996 while working on the Creedmoor force, said Thursday he had a vague recollection of the report but couldn't remember any details.

When asked about the accuser's previous report of rape, Durham County District Attorney Mike Nifong declined to comment.

Before Seligmann and Finnerty were indicted, attorneys for the players pointed to the accuser's criminal history when answering questions about their clients' legal troubles. The woman pleaded guilty to several misdemeanors in 2002.

Are we sure the BP's will be marching on the campus or will it be near the campus?

It is my recollection from the university president's email/statement that they would be protesting ADJACENT to the campus and that university security personnel would be present to ensure that they would NOT be allowed on campus.

I think Dukie '07 is right . The New Black Panther Party is a lot of talk. With the immigration marches tomorrow I'm hoping Mr. Shabazz gets little to no coverage. Ms. Guilfoyle should be ashamed for giving the guy any airtime at all.

It's a great tune. One of the 70's best. There's some actual thought and musicianship behind it and I love the piano intro with the segue into the main theme. IMHO you shouldn't want to get it out of your head. : )

When the DNA didn't come out in their (authorities') favor 2x, I also said they'll tamper. I just hope that when the next results come in, I'm wrong....that they'll again be negative for the players' DNA.

I saw and saved the same paragraphs you did. I thought they were noteworthy, also. Sad that his mom is ill, but nevertheless, he still goes in and out of the office, but for some reason, he's quiet regarding this case. Rather strange, if you ask me.....apparently you feel the same.

Nobody wants to play second string, and exotic dancers are no exception to the rule. Which becomes a problem when, by fate or misfortune, you're cast in the media drama du jour as . . . The Second Dancer.

Always a stripper, never a star.

Not if you're Kim Roberts, dancer at the Duke University lacrosse team party last month when the other dancer hired for the event allegedly was raped.

Roberts wants, badly, for you to remember her name. Because, as it turns out, the worst thing that might have happened to the accuser may have been the best thing that ever happened to Roberts. Or so she apparently hopes.

For a few days, it seemed as though no one would notice or remember Roberts. She didn't see anything, after all, and for a while she said she didn't believe the accuser's story, according to defense attorneys for the accused Duke students. Thus, she faced the unthinkable - being un-famous, an un-celebrity. Un-known.

Suddenly, the divorced mother had a novel idea: It coulda happened. So naturally, she contacted a New York public relations firm.

In an e-mail to 5W Public Relations obtained by Fox News, Roberts wrote: "Although I am no celebrity and just an average citizen, I've found myself in the center of one of the biggest stories in the country. I'm worried about letting this opportunity pass me by without making the best of it and was wondering if you had any advice as to how to spin this to my advantage. I am determined not to let any negative publicity about my life overtake me."

It was signed, "The 2nd Dancer."

First off, never write an e-mail you wouldn't mind seeing on Fox News. Maybe Roberts doesn't mind, as those who pursue celebrity seldom concern themselves with the reason for fame, only the fame itself. And, of course, the financial rewards one hopes to reap. Roberts was clear on that score.

"Why shouldn't I profit from it?" she said when asked about her willingness to profit from her colleague's alleged rape - or the ruin of two young men who may be innocent. "I didn't ask to be in this position . . . I would like to feed my daughter."

I know we're not supposed to question a person's character these days. A girl's gotta do what a girl's gotta do and boys will be . . . no, wait, that's wrong. Girls are virtuous because they're stripping to feed their children; boys are evil because they will pay a virtuous single mom to strip. It's so confusing, isn't it?

Probably more to the point, Roberts' query to the PR firm, which has declined to represent her, coincided with her new slant on events that night.

"I was not in the bathroom when it happened," she told the Associated Press. "So I can't say a rape occurred - and I never will." Later, after her own criminal record was raised, Roberts said, "In all honesty, I think they're guilty . . . and I can't say which ones are guilty . . . but somebody did something . . . that's my honest-to-God impression."

Who wants this story? Do I hear $25,500? Anyone? The $25,000 figure isn't random - it's the amount Roberts was convicted of embezzling from a Durham, N.C., photo-finishing company a few years ago.

Coincidentally, around the same time Roberts was forming her new impression of what went down at the lacrosse party, a judge excused Roberts from having to pay a 15 percent fee to a bonding agent.

I can't say Roberts is getting favorable treatment for becoming a better prosecution witness. I was not in the lawyer's office when it happened. So I can't say a transaction occurred - and I never will. In all honesty, I think somebody did something . . . that's my honest-to-God impression. It coulda happened. Or not.

In 1997, an assault with a deadly weapon warrant was never served. Bishop called it a misunderstanding with his former law partner.

And the candidate never served any time after he was arrested for resisting an officer and failing to stop in 1998. Bishop said Duke University police pursued him after he took pictures of a client in the hospital.

"I was trying to get to the Durham Police Department to save the evidence," he said.

I didn't see the show, howlin.

Great point, PTBOR, on the fact that she did not appear to be "beat up" by either the security guard or the first officer on scene. But, if that was daddy talking, who knows if she really was or not! However, if pictures of her at Duke Med show she was beat up, and pictures of her leaving the Buchanan house do not, most likely a slam dunk. How long does it normally take for swelling/bruises to appear on one's face after being hit? More than a half hour?

All these connections do seem rather bizarre. Give Hugs & Kisses credit - he did alert us to a SBI investigation into a Durham police prostitution ring in the early 90's. I think we all brushed it off because it happened so long ago; however, with the revelation that CM allleged she was raped in 1993, I have to wonder if he is on to something.

Are any reporters investigating police corruption in Durham or are they all too busy exposing the "lacrosse culture" at Duke?
