HAAAAAAAAAAAAA!
Can you even imagine what the parents must be feeling and thinking?
The guys who live in the house are pretty much sitting ducks on these reinstatements. However, I do not see how Nifong can prove the non-resident violations since he has put all the players in a position (as a potential John Doe #3) where they will likely need to invoke their Fifth Amendment privileges.
I honestly think this man is INSANE. Does he really believe this woman, after all he HAS to know about her.
The players are not going to turn anybody in because there WAS NO RAPE!!!!!!!!!!!
As far as Mangum being so traumatized she cannot sleep..blah blah blah.
I think if these hustlers think they will be getting a fat check from the parents, there will be no chance in hell of that. They'll have to fight for that money...all the way.
Do you have details about this?
He said he is reinstating a noise violation and an alcohol possession charge against Evans because he was one of the men who threw the party.
"He was one of the people who rented the house that was serving alcohol to underage people and hiring strippers," Nifong said in an interview. "
Someone correct me if I'm wrong, but it's not illegal to hire strippers. Also, just being on the lease is also insufficient to demonstrate that Evans served alcohol to minors (which he may well have done, for all I know). I'm sure their lawyers will fight this, and may win.
And anyway, while it would obviously be better to have no record at all, on the other hand a misdemeanor for a loud party or open beer container against a college kid ain't going to keep that kid off of wall street, out of medical school, out of business school, or what have you.
If this is Nifong's best shot at cracking these kids to make someone fess up, then he's got absolutely nothing.
I read somewhere that Seligmann and Finnerty weren't among the 15 players with Durham deals for prior misdemeanors.
David Evans was one of the three captains who gave statements and were interviewed on the day the house was searched. He may have admitted some responsibility in a keg being there that night, so his previous deal being reevaluated might make sense.
On what basis would the rest of the players with prior deals be in trouble? The police were called there because of Kim's 911 call about racial slurs, but even if true name-calling isn't illegal is it, and only the "cotton shirt" comment from one unnamed player was witnessed. There was no noise violation charged, or public urination, or underaged drinking that could be proved now.
So why would their mere presence at the party be grounds for Nifong to rescind previous agreements? Wouldn't they have to have been charged with committing another illegal act?
It's for sure Nifong's bet all the chips. I don't think he knows how to get off the runaway train now...
I should have phrased that parole/probation violations:

In Monday's motions, Osborn wrote that no forensic evidence links Seligmann to the alleged crimes, based on the limited information provided to the defense by prosecutors.
The case is based only on the accuser's testimony, and she has given conflicting accounts to authorities, Osborn wrote.
The defense motions asked for information about the accuser's mental health, any hospital commitments and drug abuse, and information about her probation and parole.

Roberts, 31, was arrested on March 22 eight days after the party on a probation violation from a 2001 conviction for embezzling $25,000 from a photofinishing company in Durham where she was a payroll specialist, according to documents obtained by the AP.
On Monday, the same day a grand jury indicted lacrosse players Reade Seligmann and Collin Finnerty, a judge agreed to a change so that Roberts would no longer have to pay a 15 percent fee to a bonding agent. District Attorney Mike Nifong signed a document saying he would not oppose the change.
From the PR standpoint, this could be a problem for Nifong. It will be perceived as unfair. Legality and justice have nothing to do with this case anymore, if they ever did. It's a political battle and it always has been...
Thanks for ping and post.
Yes, the election will be interesting to watch, his competitor should play this up for all that it is worth, ask the people do you want a fair shake or do you want blackmail and retribution when a case doesn't go the "persecutor's" way. I think it's time the accusers identity becomes public, this is way out of control.
We don't know how many of the 16 players were at the party, (nor does Nifong,) and of those there how many have active cases.

According to court records, 16 players were charged in the past three years with misdemeanor charges in Durham including noise violations, public urination and alcohol violations. The deals placed the men on probation for either six months or a year. They were to complete community service and, in some cases, were required to abide by the rules and regulations of the university.
Nifong said he will reinstate the charges against players whose deferred prosecution deals are still active, unless they can show that they were not at the party.
So guilty until proven innocent, Nifong is a true idiot.

Look at the title of this thread!!! Is Nifong a DA or someone out for revenge? He has to be brought up on ethics charges when this is done!!
When I said political issue, I should have been more clear. I didn't mean Nifgon's re-electio, although that's a componenet of the mix. By "political" I mean global. Good vs. Evil. Right vs. Wrong. The stakes are no less than an attempt to extract REPARATIONS via the justice system for injustices, both real and perceived.
