He said he is reinstating a noise violation and an alcohol possession charge against Evans because he was one of the men who threw the party.
"He was one of the people who rented the house that was serving alcohol to underage people and hiring strippers," Nifong said in an interview. "
Someone correct me if I'm wrong, but it's not illegal to hire strippers. Also, just being on the lease is also insufficient to demonstrate that Evans served alcohol to minors (which he may well have done, for all I know). I'm sure their lawyers will fight this, and may win.
And anyway, while it would obviously be better to have no record at all, on the other hand a misdemeanor for a loud party or open beer container against a college kid ain't going to keep that kid off of wall street, out of medical school, out of business school, or what have you.
If this is Nifong's best shot at cracking these kids to make someone fess up, then he's got absolutely nothing.
It's for sure Nifong's bet all the chips. I don't think he knows how to get off the runaway train now...
Agree on all points, and not only all that, Nifong's gone and really pissed them all off big time by doing this, as if they all weren't pissed off enough in the first place. All this is going to do is ratchet up the wall of defense.
I don't think Nifong expects this to bring him any information, which leaves us with raw malice on Nifong's part.
