All I am saying is that their diversion requirements might have included things that did not involve the law. So while hiring a stripper was legal, going to a strip party could violate a diversion agreement. In which case the DA need not show they were drinking underage nor have the arrested. He might just need to assert they were not living upright lives. But I am not a lawyer either, so I am just speculating.
True enough. But even Nifong can't make it up out of whole cloth that they WERE AT the party. Someone has to SAY, "I saw John Smith at the party." I don't think Nifong has that..

We do have a trend. I lived outside of Durham for a short while and I never knew.
And to be fair, it's not, at this point, even clear that CF was at the party.
Precisely. All we have is the word of Kim, who at best is a flakey witness and Crystral, who used a possibly non-admissable ID. Right now (correct me if I'm wrong) the only people who were at the party as a matter of record, were the 3 team captains and Seligman, who was ID'd by the cab driver.
What say y'all?
Finnerty's lawyer is the one who says very little. Has he indicated Collin wasn't at the party at all? Abrams said Collin doesn't appear in any of the photos released so far, but there are probably many more. Wouldn't it be wonderful to see Cotten cross-examine Kim about seeing "the little skinny one" and being presented with photo after photo of the gathered crowd and asked "Do you see him in this one ... or this ... or this ... or this ....?
Just thought of another thing. This is why we've only seen a few photos. None of the players are shown on the photos, right? The defense doesn't want to show any that might place someone at the scene.

Honestly, this assault charge is meaningless at this point. The trial will most likely result in some probation, not jail.

You know, we've been assuming that after Kim called the cops (1st 911 call) and then yelled at the lax team that she had done so, we've kinda' assumed that they "scattered" and left the house permanently. I have to wonder if, during the subsequent short time the cops were there, some were just down the street observing or quietly hiding out in the house. Just because the cops saw no one doesn't mean no one saw the cops. Then they could have returned to the house after the coast was clear. Does this have any effect on the timeline viz the taxi driver's return to the house to pick up four more lax players?
I didn't find the link to the AP video of Kim ... and now I'm craving Pringles. ;)
Lets recap as to who can be PROVED as to who was at the scene:
Seligman: ID'd by cab driver (defense witness) and AV (Flakey prosecution witness)
Finnerty: ID'd by AV and Kim (Both flakey prosecution witness)
Three team captains: Admitted to being at scene during questioning by investigators.
Anyone else?
