Duke rape accuser's records demanded

DURHAM, N.C. - The attorney for one of two Duke lacrosse players charged with raping a stripper demanded on Monday that prosecutors turn over the accuser’s medical, legal and education records for use in attacking her credibility.

Kirk Osborn, who represents player Reade Seligmann, said the material will provide “rich sources of information for impeaching the complaining witnesses.”

Osborn also asked a judge to hold a pretrial hearing to “determine if the complaining witness is even credible enough to provide reliable testimony.”

They are going to rue the day they messed with these people.

Rumor has it there are some lawyers in the area who claim they will spend the rest of their lives trying to undo the damage this DA has done. There are some p.o.'d lawyers and they're not all Duke graduates.

I'm glad the Newsweak reporterette finally explained what the "hint" was she had been talking about.

With a couple of weeks remaining before the election, Nifong would be doing a lot more than hinting if he had something. Time is running out for him.

If he's not the incompetent boob he appears to be, he might want to give some indication...soon!

If Crystal brings a civil suit, she must testify in the suit. And the defendants can ask her anything that's "relevant." And in a civil suit, "relevant" has a very broad meaning.

It does not specifiy what kind of pills, if they were a prescription, in a labeled bottle, etc.

Maybe Nifong thinks he has a bombshell here, especially if they were loose. "No Mister DA, they are not my pills. I swear!"

I don't know what they can do re: civil suits but they should do whatever they can to make the AV, DAs and others' lives just as miserable as possible.

I think all of Rita's blow hard crap tonight suggesting this guy us being paid off is beyond disgusting. She thinks she broke the whole case open...only not.

It just makes no sense to me.

It simply does not make sense. My own theory is that Kim and Crystal were in on the drug thing. Crystal arrived seemingly sober; but she and Crystal spent a few minutes in Kim's car together. That would account near perfectly, and within the timeline, that Crystal began falling down.

Were they all in on the plan???

I do not think in any way that the boys were in on that plan, nor did they pay for it nor request it. It appears that once the boy's assessed that "trouble" was not just on their doormat, but in the home with them, they did everything in their power to get those girls to leave. But the haggling over payment is what dragged on.

Much as I'd like to Nifong horse-whipped, he does have an eyewitness and a nurse saying there was a rape. Prosecutorial immunity probably applies. You know the AV is judgement proof. And the press has the 1st amendment, and mean, negligent and biased won't make a libel case.

From what I've read thus far; it appears there may be a deal on the table that if the complaining woman drops her case, she can maintain her anonymity.

But we know that won't happen: She'll be writing books and doing the college campus thing at $10K a pop.

Typical FNC teaser.

It was the chick from Newsweek who wrote an article this week in which she wrote Nifong hinted to her at the beginning
of the cast a month ago there was a date rape drug used.

Now we have been hearing this story all day.

Well..cut to Greta interviewing Newsweek chick, and Greta asked her to explain exactly what exactly Nifong said a month ago about a date rape drug.

Nifong said to reporter from Newsweek, "what if I tell you I have a witness that can say the AV showed up sober, took a drink from the players, then became incoherent."

That's it..basically Nifong was teasing the reporter last month with the information about what Kim said.

Now why was this made a big deal today????
A) The comment by Nifong was a month old.
B) It had nothing to do with a TOX report, but a witness.
C) We all now know who Nifong was talking about as the witness, it was Kim, who has been completely discredited.

Peach, I haven't a clue about the flame war, what it was about, who was in it -- but the thread which was pulled in result had quite a bit of data and analysis in it, last I saw early this morning. Bummer.
