Duke rape accuser's records demanded

DURHAM, N.C. - The attorney for one of two Duke lacrosse players charged with raping a stripper demanded on Monday that prosecutors turn over the accusers medical, legal and education records for use in attacking her credibility.
Kirk Osborn, who represents player Reade Seligmann, said the material will provide rich sources of information for impeaching the complaining witnesses.
Osborn also asked a judge to hold a pretrial hearing to determine if the complaining witness is even credible enough to provide reliable testimony.

I assumed he was talking about that stellar witness-Kim.

Greta, at the beginning of her show tonight, stated that NiFong said Crystal was given a date rape drug and he has proof. She was wrong on everything else, so until I hear that from somebody else, I'll assume it not true.

I understand the cabby is off on time with second call.
He remembers the time on the second call as being later, but, so what.
People have memory lapses on time.
The defense have cell phone records and a computerized cabby log, atm receipts and the card swipe at the dorm.
I think all of Rita's blow hard crap tonight suggesting this guy us being paid off is beyond disgusting.
She thinks she broke the whole case open...only not.
Add this to the fact that the big news today about Nifong suggesting there was a date rape drug, had nothing to do with a TOX report but a "witness" who can verify the AV came sober, left incoherent, and was given a drink at the party.
This was said to Newsweek...A MONTH AGO by Nifong.
Obviously he was talking about the now discredited Kim.
The media is just incompetent.

I'm glad the Newsweak reporterette finally explained what the "hint" was she had been talking about.
It seems clear that Nifong was talking about witness testimony, and not a toxicology report. Maybe Nifong has a toxicology report somewhere hidden in his back pocket, but he was not alluding to such a report in making his "hint" to Newsweak.

I have such a huge problem with the "date rape drug" being administerd by the players theory. Aside from the fact, as discussed before, that it would leave no recollection of the event, can you honestly believe that you would administer that drug with 30-40 people present (read: witnesses)? It just makes no sense to me. Were they all in on the plan???

Prediction:
It looks like we're getting close to the end game. The facts are closing in on Nifong and the AV. The AV makes up another story about being scared, refuses to testify, goes on to get book offers and appear at race baiting political rallies. MSM writes sympathetic crap about the damage done to this hard working gal.
Case is dismissed of course. Nifong is in a harder spot, does he hold on until next Monday or does he too take the route of blaming the evil defense lawyers and dismiss now. AV may force his hand.
No lawsuits are ever filed, AV knows she'll be crushed in a civil suit, defendants just want to go on with their lives.
Meanwhile Duke as a PR move in Durham hands out unbelievably harsh punishment for the lacrosse guys, based on the drinking, stripppers and racial slurs. Lacrosse program is suspended or outright killed.
One of the accused also writes a book that is well received. And the drive by media? You know, no apologies just move on to the next story.

It seemed to me Carlson said there were five non-lacrosse players at the party, and Nifong was aware of them, yet didn't ask for their DNA or include their pictures in the line-up. Why would he do that?

Well i think this is a matter of principal to the players and their parents. This attorney will be no match, and I feel he will never be able to get a settlement..no way in hell.
If Mangum does not want to be questioned in a criminal trial where there are strict rules on evidence and scope, she will never testify in a civil case with relaxed rules of evidence. I think she just wants this to go away.
