CBS News correspondent Trish Regan reports that defense sources say Finnerty was eating at a Mexican restaurant when the alleged rape is said to have occurred. And they say Seligmann may not have been in the house during most of the time the alleged rape was carried out.
According to a neighbor's testimony, the stripper arrived at the house around 11:50 p.m., although the prosecution may argue she arrived earlier.
The defense says it has time-stamped photos of the stripper. The first was taken at midnight, followed by a series of pictures over the next four minutes that show her and Roberts.
There is a time gap in the photos of the alleged victim between 12:03:57 and 12:30:12, when she's seen at the back entrance of the house and appears to be leaving. A neighbor said he believes he saw her in the front yard sometime between 12:20 and 12:30.
Based on the time-stamps, there is a 16- to 26-minute window in which she could have been assaulted. But, during most of that time, Seligmann may not have been in the house.
Sources for the defense tell CBS News that cell phone records show Seligmann made calls at 12:07, 12:09 and 12:11. At 12:14, he called a cab to pick him up. Driver Moez Mostafar says he got that call and showed CBS News his dispatch records to prove it. He says he picked up Seligmann at 12:19.
"He looked normal, nothing looked unusual to me," Mostafar said. "He asked me to go to Wachovia Bank where he can get some money.

In the article Nifong refers to himself as "a victim".
So the DA in the 1992 police corruption case was Ronald L. Stephens, who is now the judge presiding over the recent player indictments. I've wondered why a gag order hasn't been issued in this case. I wonder if Judge Stephens realizes that Nifong has acted unethically, and possibly illegally, and is allowing the defense to weigh in as an antidote.
I think it would be better if it was someone not named as a defendant or, even better, someone not on the LAX team at all whom he called on his cell phone.
One can even try to say that the complainant was "drugged" or whatnot, "ipso" she wouldn't notice. Wrong. She would have to. She would have to have been sufficiently "awake" to have noticed these things if she can even "know" that she HAD been assaulted.
Then there is the delayed "trauma" matter. I can understand the delayed trauma matter (not reporting it until later), in many instances of rape -- but not this one, given the profession the stripper was in. This means that some complex weighing it all out had to have taken place in Stripper's mind. The rumor is that she was too out of it to say anything for a time.
My theory. She was abused before she ever hit that party, and maybe again, afterwards.
That when she and Kim entered the bathroom -- one was given too much of something possibly supplied by the other stripper -- in order to maybe induce Stripper 1 to be more lively for the "show".
My question, before proceeding with my hypothesis? Once Kim and Stripper #1 left the bathroom, what happened? Did Kim wait for Stripper #1 to come out so they could continue the show? Did Kim Assess that Stripper #1 was "out of it" and therefore better make a clean break and leave, immediately? The boys had to help Stripper #1 to her car, and put her in the car. This means Kim was more than likely already sitting in her car.

If everyone bails, the case is tossed, the boys are still "guilty" in the eyes of the public, however -- due to NIFONG and the "Socialites of Justice". I'm wondering if this isn't the angle being striven for: quiet the story down so when the boys are found innocent of charges, who notices or cares?
Could be. But Rush, Hannity, Fox will keep it alive. The Driveby Media has much responsibiltiy in this case to let it die quietly. The media must be taught a lesson..
Even better! I have a feeling that this 3rd "attacker" will never be named. Nifong has got to know by now that his case is going down the toilet, and the media lapdogs are hanging him to dry.

The report about how excellent the Economy is doing had JUST hit the airwaves. It was good news, it was solid news (the MSM hated it). And then they suddenly seemed to hop all over the DUKE/DURHAM story, doing a Rodney King "CNN menu" type of thing.
Did you know... that On March 13, 2006, President Bush signed a huge package to DEAL, TO HASTEN, the processing and lab handling procedures for DNA? Like as in all those backlogged cases of "rape case" DNA? He did.
Did you hear about it?
The Duke/Durham event unfolded during the NIGHT of the 13th and the day of the 14th.
And the media went BIG, doing the entire circus and show of protests, fliers, articles, etc. THE BOYS ARE GUILTY, GUILTY, GUILTY. And they kept it up. Oprah, does a special on the plight of the poor. Daily Kos does some stupid thing about "911 hijackers" were just punks. Oh, freeakin, ad nauseum. The "massaging" of subliminal imaging is in full blown operation among the Libs with "press or public" credentials.
The MSM will attempt to bury the Duke/Durham story. And stick and assign their own culpability onto Nifong. I don't like how Nifong's been doing this case; but he's been amply AIDED AND ABETTED by those who'd like to hide their own culpability in the matter.
That's my analysis, and I'm sticking to it.

Even when charges are dropped or a not-guilty verdict is issued for lack of any evidence whatsoever, even if these two "dancers" are proven in court to be outrageous liars with a past-history that would curl most people's hair, I will guarantee you that a large portion of the local minority population and an even larger percentage of feminazis will adamantly declare these privileged white boys got off just because they were rich.
The chix have destroyed the lives and reputations of two (and 90% of a third) young men because they were angry at (a) having been booed during their routine, (b) being told to leave, (c) being accused of "ripping off" the boys for dancing for a few minutes of what was supposed to be an $800 two-hour show, and (d) heated words being hurled in both directions. Kim's righteous (cough-cough) indignation got the best of her and her desire to teach these rich boys a lesson spiraled completely out of control. I think Crystal's accusations, the main focus of this dog-and-pony show, were her desperate way of trying to avoid more jail time.
Another thing I'll guarantee you: they've gotten so much sympathetic attention and coddling from national figures and the presstitutes that they will not feel one iota of guilt or sorrow for the mess they've caused (despite Kim's protestations to the contrary: "If the boys are innocent, sorry fellas. Sorry you had to go through this.")

Finding jurors who haven't already formed an opinion is going to be difficult. If they haven't, then anyone that stupid may actually believe the prosecutor.
