Breaking overnight from Chris Cummo at ABC GMA:

Case against at least one Duke defemdant unraveling fast.

Defendant Seiligman went to bank ATM while rape supposedly happening.

12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.

Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.

Sounds like they didn't pay the strippers, and were thinking the pimp (probably armed with more than a lacrosse stick) would come after them at the house for the money.

So, the strippers may have called their pimp about non-payment. That may explain the gaps in the timeline:

This is MAJOR MEDIA BIAS.. There is NO POLICY anywhere NOT to release the 2nd strippers name.

Why isn't the media doing it? The plastered all the boys faces on the front of every paper and screen (even the ones that were NOT at the party).

Absolute untruth. The players were never ordered by the court to submit to DNA tests. Their representation received a letter from Nifong stating that if they refused to submit, then he would get the court order. The players then decided to all volunteer for testing.

Wendy Murphy, whoever she is, is a putrid, repulsive liar and has no business commenting on this case.

Once the case is called to trial, the prosecution gets to put up their case first. They must put up sufficient evidence of each and every element of the crime. For instance, in my state rape is now called criminal sexual conduct (probably first degree, from what I have heard of the accusation). The state would have to prove a penetration (I will spare you a precise definition, but it is pretty much what you are thinking) by a defendant of another accomplished through the use of aggravated force (that makes it first degree). Should the prosecution fail to present evidence sufficient for the jury to find, for example, aggravated force, the judge would direct a verdict at the close of the state's case. He might still allow a lesser offense to go to the jury (maybe CSC 2nd degree or aggravated battery), but the original offense would be gone forever. If there is no proof of identity, the judge would have to direct a full acquittal. If he did not, the appellate court would. The judge cannot dismiss the case until it is called to trial, though (caveat: many states have preliminary hearings where the case can be dismissed before trial, but usually the standard for dismissal is more lenient toward the prosecution).

You're RIGHT. See because the media acts like one side is totally virtuous and the other side is evil, they cannot see this.

The Verbal battle went both ways. The boys stopped smiling in 3 minutes after the dancing began - because one of the strippers was mouthy, insulting, and aggressive.

That has been the case in many stories. I think there is a few things going on. The first is just lazy pack journalism. Next is they just want to keep the story going as long as possible. The rest of it is just straight bias and no telling what else.

When asked about the alibi she said it's a mixed bag.

The guy charged was not there at the time the alleged rape occured! How can that NOT be the lead?

I watched the segment, he is a former homicide detective, not that it should matter but it does, he is black. He said he spoke to some of the Durham PD. He pointed out that there is not alot of info coming from the police, because they did not want to go public with any information or arrest anyone until they had time to investigate more, IT WAS THE DA WHO RAN WITH THIS and went public without the support of the police. He also said from the police investigation so far, all witnesses who they've talked to said she was really wasted BEFORE she went to the party as well as later. The Durham PD knows where she was before the party. According to what Rod Wheeler (I think thats his last name) said, the police don't believe her. With every statement she gives they cannot corraborate it. She really doesn't have any credibility.

As a sidebar, I talked to my brother today who is a detective and worked sex crimes. He said without the DNA and any irrifutable evidence, it would break down to a he said/she said, which is not all that uncommom. However the deciding factor is credibility.

One more thing, say another lawyer from NC on today that said recently there was another allegation of sexual assault involving football player. DA refused to go public with it until a complete investigation was done. As it turned out no assault.

Sorry about the rant, I wish I could reach through the tv screen and slap some sense into these people, especially the women. Not one rational thought between them. It almost makes me embarrassed to be of the same gender.

It also explains to me something I've been wondering about. The neighbor Bissey overheard someone (I would bet one of the housemates) saying repeatedly "Let's Go Guys!" just after the strippers drove away. Then he said the lights were darkened, and no one appeared to be home. Police arrived just a few moments later, and the house was deserted.

These guys were not worried about the police coming, they've come before for noise complaints, parties, etc.

They wanted to be gone before the pimp and his buddies showed up to collect the money (you know, "he got to pay da rent").

I think the defense should be able to get them once Nifong sets a timeline. At the very least they can get Kim's as a material witness.

Although Nifong may never set a timeline.
