Case Aganst Duke Student Unraveling Fast

Breaking overnight from Chris Cummo at ABC GMA:

Case against at least one Duke defemdant unraveling fast.

Defendant Seiligman went to bank ATM while rape supposedly happening.

12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.

Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.

Is this different from this case?

This was explained in depth on WRAL tonight.

There is a brand new law in NC this year; each witness is to be given eight photos, shown one at a time (not in a group), and they ALL have to have the same facial characteristics. And it goes without saying that it just can't be lacrosse players.

The photos they showed all looked basically alike, i.e., black, same kind of haird, mustaches if the accused has one, like that.

According to WRAL, the departments have just finished training the new procedures.

Indeed - rational thinking has nothing to do with this case as it's all about emotion.

If a pubic hair was found anywhere on the accuser or her clothes then that would really help the prosecution and that would be proof enough for the "if he wasn't guilty then the police wouldn't have arrested him" crowd.

It wouldn't matter that she was in the bathroom for 20 minutes where there are undoubtedly many hairs just laying around on the floor.

Correct.
In California, a drive-by ID is allowed where a 'fresh' event has occurred; I.E.
A purse snatch has just occurred. The suspect is caught a mile away. The suspect would then be taken out of the patrol unit, unhand-cuffed and as many look-a-likes that could be found, would be placed around him. The victim/witness would be driven by that location and asked "Do you see anyone you recognize?, If so, where did you see that person."
One good thing about preliminary hearings is after you've had a Public Defender shred you to pieces in front a court steno or clerk you were going to hit on, you learn fast!!!

I do get irritated when I hear the TV lawyers refer to "lawyering up" as if that was a sign of guilt.

And they would be the first ones to "lawyer up" if they were ever accused of a crime.

If she picked pictures from ONLY the Duke Lacrosse team, than the ID is worthless - TOTALLY WORTHLESS.

What if the pursed was snatched by someone wearing a school uniform and the perp couldn't be found - would a look through school yearbook be ok? Would it have to followed up by a real lineup with similar looking people?

If the school yearbook is ok for an initial ID, then could it even be more constrained? Say the purse snatcher was wearing a school baseball uniform - could the witness be shown just the photos of the school baseball team?

It's the DA's affirmative action approach to help (coaxing) a victim to identify an assailant.

Doesn't get to the truth but sure as hell wins elections.

Yeah and you would have thought that he would have known better. I would have thought that his agent and manager would have drilled that into his head.

I can see however how things can sort of slip away when dealing with the police. They show up at the door and ask very basic questions that most people would have not hesitation answering and then the next thing you know you're at police HQ getting grilled.
