Breaking overnight from Chris Cummo at ABC GMA:

Case against at least one Duke defemdant unraveling fast.

Defendant Seiligman went to bank ATM while rape supposedly happening.

12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.

Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.

Let's say a witness saw a crime committed at a school by a bunch of students. I assume that it would be ok for the witness to look through a school yearbook to see if she could pick out anyone.

Is this different from this case?

I assume the difference is that in the above scenario that if the witness picked out anyone in the yearbook that she would also have to pick him out of a lineup. I don't think that happened in this case.

I am coming to you live right now from the Durham County courthouse in Durham, North Carolina, where just moments ago, we learned of a new search of the dorms at Duke University. Police went back to the Duke dorm room where some of the lacrosse players live and continue as they look for clues in that dorm. This comes after two of the Duke lacrosse players were charged with rape, sexual assault and also kidnapping. And late today, the district attorney a third arrest may be on the way. Plus, in my exclusive interview with, second dancer who was there the night of the alleged assault told me she wants justice.

UNIDENTIFIED FEMALE: She was talkative and friendly and smiling, and definitely—we talked for several minutes, you know, normal conversation. We were getting to know each other. She was fine. She was absolutely fine.

COSBY: Did she seem that she had been on drugs or drinking?

UNIDENTIFIED FEMALE: Not at all. She did not seem like that at all.

COSBY: Are you surprised that they‘re saying that, Look, maybe she arrived, you know, banged up and bruised?

UNIDENTIFIED FEMALE: Well, I mean, like I said, I just didn‘t notice anything. There was nothing overtly banged up or bruised about her, or I would have noticed it.

COSBY: How much of a contrast was her behavior from when she arrived to when she left?

UNIDENTIFIED FEMALE: She was very different. She was different from the person that I met in the beginning of the night.

COSBY: A 180?

UNIDENTIFIED FEMALE: Yes. At least.

COSBY: So you make the first 911 call. She has to be physically carried into the car by some of the young men. Is she speaking or saying anything, at this point?

UNIDENTIFIED FEMALE: Not really. She was very out of it. She was—she was—there was almost no communication, period, and no communication could have occurred in her condition.

COSBY: You have not spoken to the accuser since that night?

UNIDENTIFIED FEMALE: No.

COSBY: Since you left her at Kroger‘s?

UNIDENTIFIED FEMALE: That‘s right.

COSBY: Do you want to talk to her now?

UNIDENTIFIED FEMALE: I mean, I have no reason not to want to. I‘m sorry for what happened to her and...

COSBY: Do you feel guilty?

UNIDENTIFIED FEMALE: I don‘t want to feel guilty because, of course, I didn‘t know what was going on. She was going through that while I‘m, you know, so close, of course, you know, I feel something. Of course, I feel something. And then you also feel, you know, Why did it happen to her and not me?

I was at Duke today guys. I know some people there and some people in the Media.

I have been told unconfirmed (UNVERIFIED) things from the start by the same people and they have all turned out to be true. 2nd Dancer was the source of the 911 call,
Accuser's name & partial criminal record, fact that the 2nd dancer lied to authorities and then later recanted.

So DON'T READ any farther if you want to know UNVERIFIED information. Look away now.

I was told today that the name of the accuser was spread around in an organized fashion at a Protest/Vigil at NCCU.
Some enterprising people forwarded her name to interested parties and the woman has been receiving MONEY from sympathic people in the black community (including Influencial millionaires). At the same time, I was told the only info they could get was from sources that would only speak off the record. They would not allow anything they said to be used with a name. I was told that many of the North Carolina (the south in General) media editors have placed limits on publishing/airing anything about the accuser on her friend unless sources are willing to go on the record. The hyper-sensitivity of Race and Rape, I guess.

I inquired about checks and I was told that they doubt anyone would be that stupid.

I had received an odd e-mail referring to some "raising cash" by the accuser and her family yesterday. So, last night I was searching the WEB (including Blogs and student newpapers hoping to find some evidence other than the Jesse Jackson stuff). I did find this last night:

"Our hearts continue to go out to the young lady as she goes through this process. We will continue to do EVERYTHING that we can to SUPPORT her.... We have learned as a result of this situation that there are other students who are victims of sexual assault who suffer in silence and need our moral and FINANCIAL SUPPORT. "

Take it for what it's worth. It's unconfirmed and unverified and a political hot potato.

It reminds me of the Clinton womanizing stuff. Investigative journalists knew about it for years, but they need sources and quotes and they raised the bar for publishing standards PURPOSEFULLY.

You know, w/the team sitting around drinking beer and waiting for the dancers to show up, any number of them would have presumably used the bathroom. So even if a hair or pubic hair from any of them is found on Crystal, who was also in that same bathroom, it would prove nothing.

These gals must be really third string. First and second grade 'talent' rate a 'minder' going along to ensure nobody gets out of line. Cold to talk about another human like that but in the world of sleaze, it's all about the money. If they were doing one on one's, there's no pretext. These ladies were out of their league.

I don't know how that will play out in court. While the photo line-up would be suspicious, and any reference during testimony to a photo identification would be suppressed, she could still point to someone in open court and say "that's the man."

However, let's look at this timeline again. I had read one post where a neighbor saw little princess sitting on the back porch from 1220 to 1230.

Using the neighbor's statement that little princess was on the back porch between 1220 and 1230, that leaves 1203 to 1220 for the assault to have occurred. This would mean that had Seligman been present during the assault, he would have called for a cab 4 times during the assault. Somewhere in the victim's statement would have to be something like - "While I was being assaulted, one of the men kept using his cell phone."

A photo of little princess on the back porch at 1230 substantiates her presence there according to the neighbor.

I do get irritated when I hear the TV lawyers refer to "lawyering up" as if that was a sign of guilt.

These guys are not rapists, but they definitely are louts.
