Woman Identified at Least 1 Duke Player, Prosecutor Says

The Durham County district attorney said today that the woman who accused three Duke lacrosse players of raping her at an off-campus party last month had identified at least one of them in a photo montage last week........... "There was no identification of any member of that lacrosse team until last week," the district attorney, Michael B. Nifong, said at an informational meeting today attended by more than 400 people at North Carolina Central University, where the woman was a student. He was answering a question about why no one has been arrested.

I agree. I think someone interprets it his/her way, repeats it as fact, and that sets the ball rolling. Pretty sad.

In recent years, attorney Wendy Murphy has been among the most vocal defenders of the Fells Acres day-care ritual-abuse prosecution, especially with letters to the editor.

She worked for several years in the Middlesex County DA's office, though apparently not on the Fells Acres trials (she may have arrived later). She may have been involved in the equally dubious ritual-abuse prosecution of the Souza family

Since leaving the Middlesex DA's office, she has been in private practice, a law partner with another Middlesex DA alumnus, Larry Hardoon, one of the original Fells Acres prosecutors. In 1999, filing a brief to the SJC in support of the Fells Acres prosecution, she identified herself as speaking for the "Leadership Council on Mental Health, Justice, and the Media." In 2000, in a letter supporting the Bernard Baran prosecution, she identified herself as an "adjunct professor" at the New England School of Law (Boston MA).

Her bold advocacy for nonsense has apparently won her a national reputation.

O'Reilly asked some lawyer last night what she thought of the pictures of the woman bruised when she arrived at the house. Her response was that THOSE photos didn't matter because no one had pictures of her genitals when she arrived! No kidding, she said that!

Do any of the boys have scratches on them from being clawed? If not sorry. Besides if she were drunk she could have been in that bathroom and fell and broke her fingernails.

Aside from being DNA tested, which is a relatively trivial procedure, I believe I remember reading that they were forced to strip (sic) and be photographed. I don't know how much clothing they were forced to remove.

Some people also went head-to-head with Nifong, who has come under fire for his seemingly slow response to the allegations.

"This young lady has identified the three men who have raped her," said one woman, Victoria Peterson.

"I will tell you, right now, that your information is incorrect," Nifong fired back. "And I will also tell you that your comments in this case are exactly what this case does not need right now."

But what get's me is that...in our system, EVERYONE knows you are innocent until proven guilty...so it's silly for ANYONE (especially a prosecutor) to speak of incriminating evidence while making no mention whatsoever of exculpatory evidence....Wendy Murphy is just a dopey talking head...but Nifong...Nifong should have stood up to the black audience and said "For now, I will continue to pursue this case, but it would be dishonest of me to pretend there are not a LOT of problems with the accuser's story".

So she remembered the face of one guy from the party, and said "he raped me." If there's no other forensic evidence of rape, that's no more than proving what everybody admits -- he and she were at the same party.

The defense has got to be salivating over the cross-examination for this allegtion.

Good grief.

One of the defense attorneys was just on Fox live.

He said they believe that Nifong has been intent on charging one or more with a crime since the very beginning and he said he expect he will try on Monday and he thinks they will get the charge.

He also said that the girl had to be forced out of Kim's car and that she never mentioned being raped until she was placed in the back of the police cruiser.

I heard Wendy retort that way to what BOR said. I could not believe it.

She was saying that unless you had pictures of her "intimates" with injuries prior to the party, well, the fact that she was shown to have visible bruises prior to the party was irrelevant. BOR wasn't only poking this hole in the case, he was using this as one of several examples that tended to call the accusation into question.

When I heard her reply I was floored.

As low as my opinion is of Nifong, I can't believe he would charge a player with rape unless "Kim" will support the accuser's story.

Did the team members call up the agencies and agree to pay then or later, when the dancers arrived? I ask this because one report had it that the accuser wanted her purse back w/the $400 and another article mentioned the $160. in her purse.

Speculation here: Could it be that the team members refused to pay the whole $400 when she only danced 3 minutes? Or if they had paid the $400 up front on her arrival, could they have taken back part of the money...even by force...and that is her motive for 'getting back' w/the rape allegations against them?
