District Attorney: Duke lacrosse case 'not going away' Associated Press
DURHAM, N.C. -- The district attorney said Tuesday he will not abandon his investigation of allegations that an exotic dancer was sexually assaulted and beaten at a party thrown by members of Duke University's lacrosse team.
"A lot has been said in the press, particularly by some attorneys yesterday, that this case should go away," District Attorney Mike Nifong said at a community forum. "My presence here means that this case is not going away."
On Monday, attorneys representing members of the lacrosse team said DNA from 46 lacrosse players did not match evidence collected from the woman who says she was raped.
"No DNA from any young man tested was found anywhere on or about this woman," defense attorney Wade Smith said Monday.
He said he hoped Nifong would drop the investigation.
No charges have been filed in the case, but Nifong has said he believes a crime occurred at the March 13 party, which according to court records was attended only by lacrosse players.
Nifong, who has said he doesn't necessarily need DNA evidence to prosecute, was calmly defiant at Tuesday's forum, attended by about 700 people on the campus of North Carolina Central University, the historically black university a few miles from Duke where the alleged victim is a student.
"The fact is that this case is proceeding the way a case should proceed," Nifong said to applause.
The 27-year-old woman told police she and another woman were hired to dance at the party. The woman told police that three men at the party dragged her into a bathroom, choked her, raped her and sodomized her. The allegations led to days of protests on and off the Duke campus.
"this case is not going away..."
I'm guessing a jury will have the last say on that, not you.
Yep, let's just keep flogging that dead horse.
"No charges have been filed in the case, but Nifong has said he believes a crime occurred at the March 13 party, which according to court records was attended only by lacrosse players."
Sounds like the crime that occurred may have been on HER part. If that's the case, I certainly hope they file charges.
"What a joke. The woman, according to the tests, DIDN'T EVEN HAVE SEX. Where's the crime?"
The crime is in the false allegations made by the complainant. She should be vigorously prosecuted.
What is going away is his reelection chances, he had a lot staked on the race card.
No, actually, DNA tests don't conclusively prove that, or that a crime didn't happen, but this sure doesn't help. The DA seems to be not entirely objective about this case, though. Just in the last few days, he promised that DNA would prove a crime.
Of course it's not going away. The feminazi's and race pimps have had a field day persecuting the guys on the Lacrosse Team and now that they've got their teeth in they don't want to let go. Sheesh...
That's the problem. It's beginning to look as though this is not about the Duke University Lacross players. It's about an existent racial tension in Durham and the DA is exploiting it to win re-election.
To be fair, I still don't know what happened that evening. Until now, it seemed to me something may have happened, but now I wonder. But whether it did or not, this case, or lack thereof, should NEVER had been in the media like this. This DA has now trapped himself and he really has to prosecute it or totally lose all credibility--and the next election. If he prosecutes and loses, he can blame it on the jury.
The president of Duke University ought to resign for not supporting his institution. He's behaved shamefully. What a dreadful president.
the gal came in with injuries...no DNA match....sounds like she got mad at these guys...and so she accused them of gang rape...NO evidence this accusation is true whatsoever...what's with this DA anyway
This clown made his announcement at a political rally for black Democrats. If that doesn't disqualify him from this case -- and from the bar -- I don't know what does.
He was right - it proved slander on the part of the woman.
Being a rich white male(first impression).
What is he doing? Is he crazy? This was an after-thought set-up to extort money from these students and nothing more. They ought to sue her for defamation and the DA ought to bring charges of false reporting. Absurd. Obscene. Ridiculous.
The actual crime committed is by that lying blk female. She should be charged with a crime. Then the young men accused of gang rape should file a suit against her. She has NO money or assets but a point needs to be made bigtime.
27 going on 50!
Doesn't the DA realize that if he were to Win this case in spite of the lqack of DNA evidence, he would be screwing up the chances of his "Brothers" getting out of prison based on any new analysis of DNA evidence that proves they were not the ones perpetrating the rape and/or murder?
He is playing with a Two Edged Sword here.
RamS
The need a Grand Jury. But which of the "White Boys" do they charge?
