Married man is suing for date

EHARMONY REFUSES HIM UNTIL DIVORCE

John Claassen wants a date so badly he's suing for one.

He's taking eHarmony.com to court, because the popular online matchmaker refused to find him the perfect mate.

Why? Because he is married.

Technically, Claassen says, he is legally separated. But that's not good enough for eHarmony, which says it is in the business of matching singles ``free of relationship commitments.'' That puts him in cyber-dating limbo.

``Most people don't file a suit to get a date,'' Claassen said Friday after filing a civil rights suit last week in Alameda County Superior Court. ``If I had my druthers, I'd be divorced by now. I'm emotionally in a different state than I am legally,'' the 36-year-old Emeryville lawyer said.

Claassen alleges eHarmony is discriminating against him on the basis of his marital status. He and his wife of eight years separated last May, and he expects the divorce to be final within two months. When he reached marital status on eHarmony's online compatibility profile, he responded truthfully: ``legally separated.''

But eHarmony says its policy is clear: No marrieds need apply.

Citing California civil code, section 51, Claassen alleges eHarmony, based in Pasadena, is breaking state law because it is denying him access to its matching service based on marital status. He seeks $12,000 in civil penalties.

Well, even though he's legally separated, he's still legally married. He'll be single... legally single I might add, once he gets divorced. In the meantime, eHarmony has the upper hand. However, since he's a lawyer, who knows... he probably found a loophole in the legal separation issue. :-)

Never tried the internet thing. Willing guys are everywhere, but Mr. Right is nowhere to be found. Hanging out with a Mr. Not Bad is fine, but I refuse to hang with Mr. Better Than Nothing. I have my standards.

He can go to any other group online or offline and date, even though he is just months away from divorce? Why does he choose the one that doesn't allow married people to join? Attention and money would be my answer. Oh, and this violates his civil rights. Anymore if someone doesn't get something they want, they cry about their civil rights.

After being browbeaten by a friend, I filled out the LENGTLY questionnaire on eHarmony and submitted it. At once, I got a response back that said I was not compatible with anyone. Grumble.

My daughter filled out the questionnaire at eHarmony and got the same response. I was actually glad that they didn't have a match for her, but I must say the mother in me couldn't understand it.

Thanks for the thread iPod Shuffle! and for the ping Lucy...Obviously a good lot of potential for discussion!

I cant help but wonder now that this is all so public how this would impact the divorce results/hearings/kidz custody?

I Know too little at all about all of the legal background & possibilities, but knowing that the courts move SO slowly.. he will be divorced no doubt before this makes any headway thru the legal system is my guess.

Well, technically, William Shakespeare DID write that line - I do not know if he agreed with the sentiment or not - which (again technically) actually points out at least one very good reason re: tyranny why NOT to kill all the lawyers ; )
