While it is not my cup of tea, and I would not want my daughter working there (if I had one) and would discourage my sons (who I do have) from going there, the place is a legally operating business.

The university is wrong on this. I hope they do the right thing and avoid the lawsuit.

I'm siding with the University. Sounds like they want their cheerleaders to be seen in a certain way, wholesome young ladies. Half dressed waitresses doesn't fit the image they are trying to project. And it sounds like she signed an agreement stating such.

If it's a double standard they might want to review policies but cheer leading is a privelege not a right. I kind of look at it as a club. If there were rules and she agreed to them she should have tried to get changes but not have broken them.
