This could all have been prevented if they would just ban smoking and guns in New York City.

And if they would just end the brownshirt war on drugs, that guy could have been happily smoking marijuana or crack instead...

Right. What these 2nd degree murder laws usually do is this:

Two guys get guns and go down to rob a store. They don't intend to kill anybody, but while one of them gets careless and discharges a round, killing the clerk.

It can be a total accident, but both the robbers are guilty of capital murder because the killing happened in the course of a felony: armed robbery. They didn't mean to kill anybody, but if they hadn't set out to commit an armed robbery, nobody would have died.

In the cigarette shooting, if the killing happened in the course of another felony, and there's probably something felonious about popping off rounds on a city street, Singh can argue all he wants that he didn't intend to kill anybody, and it won't help him a bit.

He can still be convicted of capital murder and executed, even without premeditation.

Oh, I suppose if one is an inebriated idiot, one might be intending only to frighten. Doesn't matter, though; a killing in the commission of a felony is murder.

You have fired a pistol, right? It's a lot harder than most people think, especially in a moving vehicle, at night, possibly with a load on.

I'm not a lawyer, but I think the standard for premeditation is a bit higher than that. And, as I noted above, there's no accounting for what an inebriated idiot might do.

So it's basically causing a death during an act of personal stupidity.

Like 'vehicular homicide' if someone purposely travels the wrong way on an interstate and causes an *accident*.

Well, during a felony. If what you're doing is stupid without being a felony, then other laws apply.

Similar in philosophy, I think. You might not have intended to kill anyone, but you did intend to commit this other crime, and if you hadn't done that nobody would have died.

So, if he is suspected in one murder and is believed to have been plotting a second, why, in God's name, was he out on the street instead of behind bars?

I don't get it.

I'm sure he was a fine upstanding citizen who was merely a suspect in both of those crimes. After all, he may be a suspect but he hadn't actually been charged from what the article says.

Of course the poor upstanding citizen was again himself a victim in the latest incident. We all know how those eeevil guns can leap into someone's hand, start indiscriminately firing and end up by a fluke, hitting and killing someone. Besides, how dare anyone ask for a cigarette with the intent of committing the crime of smoking!
Need I add a /sarc?

This sort of extreme sensitivity to perceived insults is usually caused by growing up in female-dominated, welfare families. If we checked out Singh's background I am willing to bet that he had no father. He was raised on welfare. His mother had a long sting of men who were hopping in and out of her bed. She was very vocal in her disrespect for them and, while growing up, he never saw a man who sheltered and provided for his family.

With this sort of background a young male never learns to be a man. In fact he is barely civilized. Never seeing a proper way to express his masculinity he turns to the extremes of violence to feel like a man.
