Deputies arrested the stepfather, Brian Wallace, and the girls' mother, Juliann Wallace, on charges of child endangerment.
Although the mother had nothing to say when she left court, her ex-husband did.
Sullivan flew home from Iraq over the weekend to ask the court to give him full custody of his young daughters.
The state was not quite ready to award custody to him.
"Apparently they've been fighting for three-and-a-half years and they're still fighting over custody of the kids, which doesn't help the situation at all," said Cecilia Longoria of Texas Children's Protective Services.
It has been another phase in a custody fight that continues to rage on.
The Sullivan girls are currently in foster care.
There are more questions than answers and plenty of uncertainty surrounding the case.
For example, what did the 3-year-old do to get locked in the garage?
Accusations have come from both sides and a judge will try and sort it all out at the next hearing on Tuesday.
Maybe she really deserved it. [/sarcasm]
She is clearly nuts. He's been trying to be a good dad, and fights for custody, and they still won't give him thekids?

I can't imagine that a 3 year old could *do* anything to justify being locked in a garage; or any child of any age. Locking oneself in accidentally is another matter but obviously, this is not the case. There's no way a three year old can fight this and the mother is just as bad; she sided with the piece of crap agianst the child. She doesn't deserve to keep them. I hope the biological father gets them.

The good news is Texas Family Courts are a great place for fathers when they are in the right.
