At the risk of alienating the roughly 1/3 of FReepers who, judging by the FR poll, support the Miers nomination, I believe its withdrawal has now become a question of when, not whether.
The final nail was probably the John Fund article in this morning's WSJ which strongly suggests that if hearings proceed, some very messy matters regarding the Texas Lottery and W's National Guard service will be dredged up. Here's a link to the Fund column:

Note also that, after staying above the fray, the influential Wall Street Journal editorial today calls the Miers nomination a "mistake."
So with this as preface, and again, with apologies in advance to FReepers who might be outraged at the exercise, I am starting this pool to predict when the announcement will come - be it from the WH or from Ms. Miers herself - that the nomination is being withdrawn.
I'll start the ball rolling by putting in my pick at the early end of the spectrum:
Monday, October 24th, 5 PM.
Have at it!
YOu don't feel it's more likely that on the eve of the hearings, the WH would see the handwriting on the wall and spare itself and Miers the embarrassment of a poor performance at the hearings and a Judiciary Committee rejection?
;^)
Noted. Plausible scenario, IMHO, though I'm sensing that things are coming to a head more quickly.
So do I put you down for Saturday the 22nd? To be eligible for the Grand Prize, please also furnish your predicted TIME of withdrawal.
LOL. Well, if that's the way she plays it, you can be sure that I'll be all over it at NewsBusters and here ;-)
Threat of recess appointment might be worthwhile if the candidate they threaten to appoint is Bork. (i.e., if they dont vote on Bush's nomimination, whoever it is, its Bork for recess appointment).
Friday October 28.
I ain't bettin' on nuttin'
Here I am, sitting in my asbestos suit, and pleasantly surprised not to have had a major flame fest unleashed on me.
Thanks to all Miers-supporting FReepers for taking this pool in the serious-but-good-natured spirit in which it is intended.
13:13 GMT, I'm in!
For Grand Prize eligibility, please supply a predicted time on Oct. 28th.
After she gets confirmed, are you gonna start a thread that says you aren't gonna start any more of these kinda threads?
4:30pm.
LSU 24, Auburn 13.
Hmm, GMT - nice touch! So I'll make that 6:13 PM ET. For all those submitting times without specifying a time zone, I will assume Eastern Time.
Does anyone seriously believe that if she does withdraw that the President has the slightest chance of getting an 'acceptable' (to the right wing) conservative nominee through the senate? If anyone thinks for one second that the Republican majority will actually act like a majority and pull the nuclear trigger, they are saddly mistaken. At least with Miers we have a chance that Roe v. Wade will be overturned.
Noted - you're in!
W Must see this thing through now.
This is the equivalent of his father's "read my lips" crisis. W's political enemies {and nearsighted friends} are {figuratively speaking} putting their arms around his shoulders and saying, "C'mon, George, just capitulate on this one issue and then we'll be your friends." His father took the bait and, thus, handed his adversaries the hammer with which they beat him to {political} death.
Politically, the WORST thing W could do now is withdraw this nomination!
