BUT: Gov. Bush could send in the guard, then if he is deemed to have broken any law, his brother Pres Bush could pardon him.

Governor Bush can't send the Guard, because Judge George Greer forbids it. Greer probably wouldn't allow Jeb Bush to pardon himself, and he'd face probable impeachment. Clinton, for his part, never tried to pardon himself for his crimes. (President Bush has no authority to pardon state criminals.)
