What should the President do about Schiavo? (legally/vanity)

Judge George Greer, the Supreme Law in the State of Florida, has removed all of the abilities of Governor Jeb Bush to save Terri Schiavo. I don't know that anyone could save her at this point; a week of dehydration may have done irreversible damage. Still, we must try.

The Fourteenth Article of Amendment to the Constitution of the United States, states,

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

Congress is so lethargic and dominated by pro-death Democrats that it surely will not exercise its power in a reasonable time, and its last attempt ended in failure. Contrary to the orders of Judge Greer, Terri Schiavo is not (medically) a xerophyte who can wait until next year for some water. She desperately needs water today.

Florida is bound by the Fourteenth Amendment, and the federal government required the state to accept this article to regain its status as a state after the American Civil War. The State's obvious flouting of its obilgations under the Fourteenth Amendment should rescind the provisions of the Compromise of 1877 that lifted the federal military occupation of Florida during the Reconstruction after the Civil War.

The Congress should have exercised its delegated (Article I, Section 8) power "To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions." Moreover, "The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States" (Article II, Section 2). The President also swore or affirmed that he would "to the best of my ability, preserve, protect and defend the Constitution of the United States" (Article II, Section 1).

These powers should allow President Bush to declare a judicial insurrection in Florida, and thereby to call forth both the Florida National Guard and any regular troops in the vicinity to suppress this insurrection.

Suppressing this insurrection must involve--at minimum--rescuing Terri Schiavo and airlifting her to a military hospital in another state. The troops also must hunt down Judge George Greer, Attorney George Felos, and adulterer Michael Schiavo, the triumvirate who started this incurrection.

Alternatively, the President could use the José Padilla precedent to declare Terri Schiavo an enemy combatant. While this action would remove the jurisdiction of the Courts over Terri Schiavo and remove her abusive husband from the equation, it might set the Padilla problems on even more shaky grounds, and I do not advise it.

The Pres should reconvene the Warren Commission. This was not a judicial homicide. It was an assassination by LBJ (Liberal Bastard Judge).

There could be a big stain on the family name of "Bush". But that does not mean that the law-worshipping members of the GOP should get snotty with us. What we are saying is reflective of the nation as a whole, at least after the nation has had time to get informed. FReegards....

Atleast I understand what you were supposed to be fighting for.

You may be correct, but an alternative scenario is that many middle of the road voters who voted for W on terrorism and security are now unhappy because of "government interference" in a "family matter."

I do know in my circle of acquaintances, the pro Terri - anti Terri division is even more marked than in the polls. 80% think the courts have handled this (I've tried to point out some of the irregularities), and that Congress (the president) has no business getting involved. They always mention "I thought the Right was for less government." So, I don't know which of the above scenarios account for W's decreasing popularity, but in based on the folks around me I'd guess it's the latter:(

While I don't think leaders should govern by polls I'd be interested in seeing questions aimed at teasing out just this question. Is W losing more from the Centrists or the pro-life single issue Right.

I hate to say it, but what we are witnessing is not the most depraved act in 60 years.
People are legally starved to death and euthanized in this society.

Also, an hour away from me in Wichita is an abortion mill.
Their very profitable business uses saline and vacuums to kill babies....again, all perfectly legal.

To put it in perspective, at least Terri got multiple attempts at the court system.... the babies in the dumpsters don't even have TV Cameras lined up to film kids bringing them water.

When it comes to depravity in America, there's a lot going on if people just pay attention...

No. Mr. 'Read My Lips' wasted your vote. No need to blame yourself. That's a moderates' trick to keep you from 'straying off'. You didn't like him raising taxes, I assume, and you let him have it.

No. Lack of knowledge and internet access, lack of the New Media got Clinton through the door. He's the last of the great democrats, because the now it's very difficult for a tax-and-spend liberal to win the White House.

Agreed. But we may be in for a very interesting primary fight for 2008, unless Christian Conservatives whimper off and pretend that everything's ok in the GOP.

Only after the primaries. I would agree then. But from now until then, we actually have the luxury of being idealists. Thank God!

Unfortunately, George Bush is both a coward and too intellectually shallow to stand up to his advisors.

I stop short of calling him a coward. He did take a huge risk by what he's done already. That is better than nothing.

If I have the correct understanding of a baby dying in Texas because of a bill he signed, he is somewhat caught in a double bind, and more hay for his political enemies.

Not being in either the president's or Jeb's shoes, I hate to say too much unless I know without any uncertainty that I would have the courage and will to do it were I in a position to do so. I would like to think that I would be willing to lay down my life/career/assets for hers. People who have fought for the right have been jailed and have incurred huge legal expenses. I don't know how that Texas family is going to pay theirs. People criticize them for allowing their children to do that, but it is going to cost them and they undoubtedly knew it going in.

His own people have turned against him for meddling in states' business. Democrats can meddle in states' business, but when Republicans attempt to do it, it is another matter and could literally rip the country apart at the seams.

This is exactly what the terrorists are banking on BTW.

I'd like to see that too.

I am not a single issue voter, and neither are most people on the "Right".

There is must more to the Constitution than just life, but you can't have liberty without it.

I am very passionate about all my constitutional rights.

This Terri Shivo situation is a hot topic every where I go.

I walked into a bar this last week and heard some working men talking very upset away how wrong this is.

I have personally only heard people say that she should live and the parents should be able to care for her.

Escape is not my plan. My plan is for pro-lifers to actually take control of this party. Many thought we are. That's why they worked so hard to build it. If this party has been using us and stringing us along, we need to take it from them.

Please explain to me what you mean by "irreversible damage." And what does it have to do with deciding whether or not to save her life?

I know it could be a reaffirmation for the intensity of emotional motivation. I don't think her condition has anything to do with trying to save her or not.

If I am mistaken, please explain to me why her condition determines our level of intensity to save her life.

Her right is inalianable. It transcends even the Constitution, although the Civil War had resolved the matter of torturing helpless people.
