It is vital that motorists are in proper control of their vehicles at all times and are fully concentrating on their driving.
The magistrates supported this and found the defendant guilty.
Sounds like the Magistrates don't have the capacity to concentrate on driving even without an apple.

This is all about trying to crush her because she is the one who stood up and said this is silly, the solicitor told the court. The police service and the CPS do not like to be told they are silly.

From my perspective, I never eat lunch, slurp diet Coke, talk on the phone while negotiating passing a vehicle in my standard transmission BMW at 90 mph.
The best bumper sticker I have seen states, "Hang Up, and Drive."
Tinfoil hat on, wearing Nomex, and the Simpson 5-point harness cinched, and the Sig is chambered.
BTW, does anyone think that Caroll Shelby developed the 1964 AC Cobra Cobra wearing perfume, having his nails done driving a modified AC Bristol (289 cu in roller-tappet Ford mill) at 137 mph?
I cannot count the number of times that I have been on projects where personnel walk from their offfices towards their cars and fire up their dopey cell phones. Too many insecure people on this planet.
Yes, I have a cell phone (Nokia Personal Communicator) that I bought in Luzerne Switzerland three years ago which is also a computer; cost $U$D 600. I have only used it once from the BMW while in motion.
