GOP Has Its Boot on the Neck of Schumer and the Democrats, and Aren't About to Remove It

The Supreme Court's decision to allow the administration to pay only partial SNAP benefits during the shutdown gives Donald Trump and the Republicans in Congress a clear road to victory in the shutdown fight now entering its 39th day.

SCOTUS recognized that this is not a separation of powers constitutional issue. It's a political issue, and the Supreme Court tends to avoid intervening in political disputes. The ball is now firmly in the hands of the Democrats, who have gotten themselves into a no-win situation.

Senate Minority Leader Chuck Schumer tried a delay gambit, offering to reopen the government if the GOP would allow Obamacare subsidies to continue unchanged for a year. Senate Majority Leader John Thune (R-SD) was having none of it.

“They’re feeling the heat, and they know that their last proposal was unserious and unrealistic,” Thune said. He referred to the Democrats' offer as a “nonstarter.”

Schumer's "offer" was ludicrous. Republicans offered last month to maintain the Obamacare subsidies in the stopgap Continuing Resolution (CR) proposal that would have funded the government through Nov. 21 (now through Jan. 20), while the two sides negotiated on the subsidies.

The ploy didn't work. The offer of a "clean" CR is still available, and Democrats are only painting themselves into a corner by not accepting it.

However, Schumer is caught in his own trap. He raised expectations among the Democrats' base for a fight to the finish, and if he doesn't deliver, people will start asking questions about why he didn't take a deal a month ago. At that time, Schumer sought an agreement tied to a permanent extension of Obamacare subsidies and the repeal of Medicaid cuts that Trump had signed into law the previous summer.

Schumer needs to sue himself in federal court to get a judge to order him to vote for a CR.

Then he will have cover.

How is that possible?

A judge in the Judicial Branch has ordered the Executive Branch to spend money which has not been appropriated by the Legislative Branch. How can the judge do that?

Can the same little judge order the Legislative Branch to pass the Continuing Resolution to fund SNAP? "Listen to me you lowly Democrat Senators! I am a Rhode Island District Court judge! I order you to pass this legislation! You must obey me!"

Seems to me that this is nothing but a Separation of Powers issue. The judge has no role at all and should shut up.

This article is one reason why I’m not in favor of ending the filibuster right now, let the Democrats eat this shutdown.

If they ultimately cave, the leftwing base will go insane.

If the Republicans had a real fix for Obamacare that would lower the cost of health insurance and the Democrats would not go along, then ending the filibuster makes sense, ending it how basically bails out the Democrats from all the political fallout.

Schumer’s taking the heat for this, but is Nancy Pelosi whispering in his ear? I can see her wanting to take a last gouge at Trump. Schumer doesn’t come across as smooth enough for it to be his idea.

The democrats are so blinded by their irrational hatred of Trump, I don’t think they will ever concede. I really think they would rather see America fail, than to allow Trump a win.

That is why SCOTUS slapped down the lower court judge. That Judge was trying to make it a separation of powers issue.

I think you have it about right. I was relieved when Thune dismissed schmukie’s offer as unserious. Where is the appeal of that hacks ruling that cannot remove unneeded Gov. employees?

Never underestimate the Republicans' skill at snatching defeat from the jaws of victory. If Trump wasn't president, I think they would have already issued a preemptive unconditional surrender.

I don't think they'll cave.

Schumer would probably prefer to make a deal and move on but he's not allowed to do that.

Nah. Schumer is looking for a way out without losing face. And the media is giving him a platform.
