Liberal judges on a federal appeals court just sided with unelected Washington bureaucrats and gutted one of Congress’s most powerful tools to rein in the runaway Administrative State, the Congressional Review Act (CRA).
The CRA is clear, when Congress repeals a regulation—and the President signs that repeal—federal agencies are barred from bringing back the same or “substantially similar” rules.
That safeguard is critical to protect American workers, families, and businesses from suffocating regulation. But according to Senator Eric Schmitt, that safeguard has now been shredded.
“Led by liberal judges, a federal court just undermined one of Congress’s most powerful tools to rein in the Administrative State. The court’s decision allows unelected bureaucrats in DC to impose rules that Congress and the President expressly rejected,” Schmitt wrote on X.

Wouldn’t even need a CRA if agencies would stay in their assigned lanes... but that’s why they were created: to control the sheeple in any manner they want.
All congress has to do is not fund the courts that disagree with them.
Democrat judges can rage all they want, but if nobody pays the cops who will do their bidding?

The law really is too vague. What does “substantially similar” even mean?
So here’s an idea. A regulation is just a law under another name. And federal agencies have no right to make laws. So take that power away from them completely.
If a regulation is so important, have Congress pass a law enacting it.
Will that delay important regulations? Probably. But we live under way too many restrictions as it is.
That’s what I thought to. It was supposed to been a done deal and stop crap like this from happening. The Supreme Justices should be livid at these judges snubbing their ruling.

Yep....they don’t get the say, or, the authority to do this.
I think there ought to be a “three strikes” law on some of these high-ranking judges. Three overturns by SCOTUS and you’re out. Best you can do is to back to judging parking tickets.

Actually, they could also cut the funding of the agencies that are defying Congress, by an amount that is several times what it costs to enforce the regulations in question. This was done to the BATF years ago, and they got right back into their lane. Money talks, BS walks.

They wiggle out of that by saying that it isn’t a law since only civil penalties apply.
BUT if the regulation was WAS willfully violated, THAT IS a federal crime, and thus if you catenate the two together, voila! A regulation has the weight of law.

I’d like to see the legal rationale behind their decision. Probably nothing more than, we say so.
