Defense lawyers always claim searches are illegal and evidence should be excluded.
There is nothing illegal about searching the backpack of a known fugitive wanted for murder. Probable cause is already established.

Seems to me, cops certainly had probably cause here.. so sounds to me like the defense is just grasping at straws trying anything to get evidence surpresed.
I don’t think it will result in a mistrial, but it could result in a lower charge of something. They have him on video taking the shot, so they don’t need the gun. They only need him taking the shot.

This depends on the sequence. Was he already arrested on suspicion of murder before the bag was searched? Or was the bag searched first before he was arrested for suspicion of murder based on what was in the bag?

Just because they claim the backpack needed to somehow be under warrant for a search - that does not mean the judge will even consider.
It seems like a very far-fetched demand, unlikely to be granted.
