2 Democrat Appointed Judges Extend Block on Trump’s Use of Alien Enemies Act to Deport Illegal Aliens

Two Democrat-appointed federal judges have extended temporary blocks on the Trump administration’s use of the Alien Enemies Act to deport criminal illegal aliens.

U.S. District Judge Alvin Hellerstein has extended an April 9 order for another two weeks that bars the Trump administration from deporting illegal aliens being held in Southern District of New York without first providing them with an opportunity for a hearing.

During a hearing Tuesday, Hellerstein, a President Bill Clinton appointee, criticized the Trump administration for its approach to deportations.

“This is not the Inquisition, it’s not medieval times,” Hellerstein said.

Until the New York court rules further, Hellerstein’s order prevents the deportation of about a dozen illegal aliens currently detained in the state.

In Colorado, U.S. District Judge Charlotte Sweeney, appointed by President Joe Biden, granted a request from the American Civil Liberties Union to temporarily bar the Trump administration from removing illegal aliens under the Alien Enemies Act.

Sweeney’s order requires the Trump administration to give at least three weeks’ notice to illegal immigrants in Colorado of the government’s intended plan to remove them and requires that illegal aliens be informed of their right to due process.

After designating the Venezuelan prison gang Tren de Aragua as a Foreign Terrorist Organization, the White House announced in March that President Donald Trump would use the powers of the Alien Enemies Act of 1798 to remove members of the gang from America.

On Saturday, the U.S. Supreme Court ordered the Trump administration to pause the deportation of some Venezuelan illegal aliens using the act until the court can rule further.

The High Court did not grant or deny the use of the Alien Enemies Act to remove the illegal aliens, who the Trump administration claims are Tren de Aragua gang members, but instead the justices simply hit pause on the matter.

The flurry of court proceedings on the use of the Alien Enemies Act to remove illegal aliens started making headlines in March when Washington, D.C. based U.S. District Judge James Boasberg directed the Trump administration to stop the removal flights of illegal aliens to El Salvador.

The Supreme Court in early April ruled to lift Boasberg’s temporary restraining order, determining that attorneys for the illegal alien should have filed their lawsuit against the deportations in Texas, where the specific group of illegal aliens in question were being held, instead of filing in Washington, D.C.

Despite ongoing legal challenges to deportation efforts, the Trump administration has carried out more than 100,000 deportations since Jan. 20.

“This is not the Inquisition, it’s not medieval times,” Hellerstein said.

More importantly it is not 1775 when British Crown judges can order people about as if they were the King.

Biden was able to deport illegals at greater numbers. Something stinks.

Arrived here illegally, participated in a violent gang, adversely affected Americans. Yet, this is what the democraps are fighting for.

I think Senator Von Holland should be required to house these thugs in his home, his neighborhood.

Just in. Federal district judge rules Trump has to submit an environmental impact report before the judge allows him to urinate each time in the bathrooms in the White House. 👨‍⚖️📄

SCOTUS rules the judge did not overreach in decision.

It really doesn’t matter who appointed them by this stage. Even non-commie trash judges are owned ‘cause they repeatedly went to Epstein island or just like kiddies.

Hint, if they support transition, they are groomers.

Another exe-cutive in black robes. They should start wearing the original pointed hood that those robes are a carry over from. Especially when they are making laws and exe-cutive orders from the bench sans due process.

I believe that Congress has the power to impose regulations on the courts. Including the USSC in many cases.

Clause 2 Supreme Court Jurisdiction

“In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.”

At Gitmo, it’s virtually a 5 star hotel. Just ask any military member who has been stationed there. No we need a prison camp in Point Barrow Alaska

Why can the Supreme Court decide overnight that Trump CANNOT deport - but can't decide on judicial powers "trumping" the executive with nation-wide injunctions?

And what's this BS about right of due process - when they are ILLEGAL ALIENS!

“This was the mistake that Trump made..instead of using the Aliens Enemies Act he should have just deported people back to their home countries for being here illegally..you are here illegally you are GONE period.”

You are confused. That is exactly what he did. He did NOT go to court to ask permission for the deportations. The Alien Enemies act is what specifically allowed HIM to deport them in a manner to be determined by him.
Numerous advocacy groups ran into court and filed cases. Federal judges started issuing injunctions despite the law specifically not allowing for that. A court is only involved if someone here needs to file a suit against a departing alien.

Trump correctly invoked that act. That allows him to bypass the courts and deport them. This is a power grab by courts who have no jurisdiction under the act.
