‘DEMOCRACY AT RISK’: Pressure Groups Suing Trump Lose Their Minds After Facing One Ounce of the Left’s Own Medicine

Leftist groups that are suing to block President Donald Trump from fulfilling his promises to the American people can’t take the idea that the administration refuses to roll over and play dead.

Twenty-two leftist pressure groups—sorry, “civil rights organizations”—released a statement warning that Trump’s “dangerous assault on the legal profession and the rule of law” represents a threat to “the viability of our democracy.”

That’s rich.

It’s particularly rich coming from the side that got lawyers disbarred and prosecuted for merely representing their clients in challenging the results of the 2020 presidential election. (Oh, did you think we’d just forget about John Eastman?)

What did Trump do to ostensibly undermine Justice with a capital J, you ask?

He directed the attorney general and the secretary of homeland security to pursue sanctions against attorneys and law firms filing “frivolous, unreasonable, and vexatious litigation” to block his administration’s priorities.

Forget a threat to democracy or to the legal system—it would be a stretch to say this is anything more than humdrum.

“Any litigant, if they think their opponent is making a frivolous argument, can seek sanctions, in any case,” John Malcolm, director of the Meese Center for Legal and Judicial Studies at The Heritage Foundation, explained in an interview with The Daily Signal.

The dumbasses are lawyers. So, do what they do. Go to court and practice being a lawyer. And stop whining. Easy peasy.

These civil rights NGO’s exist to graft millions of dollars in grants and launder some of it to high price Washington law firms by “hiring” them to pursue frivolous litigation. They don’t really care if they win, the whole point is to funnel the money to the lawyers.

The communists need to take legal action on the guilty judges not Trump.

None of this legal expense comes from Trump’s wallet. The US can bring brigades of lawyers indefinitely.

The Left will discover that.

This is exactly right - Rule 11 of the Federal Rules of Civil Procedure is radically underused, mostly because lawyers don’t want to rock the boat and potentially face retaliation from other lawyers and because judges really don’t want to deal with the extra work of determining that claims are frivolous. In my own practice, probably about 5% of lawsuits were totally frivolous, everyone involved knew they were frivolous, but no one wanted to pull the trigger on a Rule 11 motion.

This executive order is brilliant. If there’s one thing that scares most lawyers, it’s Rule 11 sanctions (or the state rules of civil procedure equivalent) since a successful Rule 11 motion can easily lead to referral to the state bar for additional sanctions (including disbarment) and opening the lawyer for malpractice lawsuits by the client.

The other reason Trump’s directive is brilliant is that it shields DOJ lawyers who seek Rule 11 sanctions for frivolous claims. Instead of the motion impacting their personal reputations, they get to claim that they had to act in accord with the directive.
