How can state election protocols permanently change to safeguard against fraud?

Posted on 11/09/2024 8:57:49 PM PST by CondoleezzaProtege

Aside from the Bush/Gore recount fiasco — Election *Day* is supposed to mean just that. Absentee ballots were for military servicemen and expats overseas.

What steps need to be - CAN be taken - for this endless counting into oblivion to stop, especially in states like AZ, CA, and NV?

.

Death Penalty for Perjury!

This probably will require each state to codify. So be it. Help them bigly.

No. The US Constitution gives the power to regulate elections to the states. The only thing Trump can do is purpose a Constitutional Amendment or have the GOP make this an election issue at the state level.

Well, #1 you need to define “election fraud”. #2, for each type of fraud defined, a remedy must be provided.

As an example, take “ballot box stuffing”. How do you define what constitutes a crime in sufficiently clear language that it will stand up in court? After you do so, what happens if that crime is committed?

Today most election laws provide for fines or imprisonment of individuals but nothing about the election itself. A different penalty should apply if it’s 10 ballots vs. 10,000 ballots.

I don’t think any state today provides for an election to be invalidated and repeated if fraud is proven. The only way to negate the impact of fraud is a “do-over” but we’ll need much better laws before that ever actually happens.

NOt true

Article 1, Section 4

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

State are responsible for running the election, but Congress can put standards, they could pass a law requiring ID for example (or course if the Dems get in power they could ban ID)

>What is within the future Trump Administration’s power to reform the electoral process?

Directly, almost nothing, and like other respondents I am against trying to break the Constitution to force States to do things. Among the other reasons that’s a bad idea is that if you once do so, the moment the left gets that power they’ll abuse it horribly.

Instead, Trump can work with States to protect the vote integrity as they pass laws that require one valid, living, citizen per vote. The Federal government can support development of systems that take the financial burden off State to do it right and cooperatively work on standards of balloting, tallying, and verifying to help make the norm an untamperable ballot.

This is a great time to do it because doing so isolates the blue fraud-driven States, and as others get better at doing it right, fairly, and quickly the outliers look more ridiculous and stupid. Ridicule is the one thing the left can’t stand because their ideas are idiotic; they only get any traction by being taken seriously.

Yup- That’s what I have been saying. It would take a constitutional Amendment to set things right. Of course that is not likely to happen. The cancer is still very strong.

Candidates should check overseas vote totals to make sure mail-in vote totals
from abroad square w/ the number of eligible voters the state lists as living abroad.

========================================================

Reference

Last August, we learned that Democrats are committing $300,000 (that they admit to) to register and influence 9 million overseas voters — even though the federal government says only 2.4 million legal voters live in other countries.

That’s 6.4 million votes Democrats want to find...that don’t exist. The group financing the efforts——Democrats Abroad—— told CBS News that the ballots are “likely to favor Democrats."

The Tuesday election day was set by Congress, wasn’t it? Can they now add “... Hence, the only ballots that count are the ones that are submitted that day or arrived by that day.”

Electing the same people, every 2 years, to congress is a huge machine. UNIPARTY will not be changing this on their own.

Make AMERICANS Great Again.

Instill a respect for the rule of law,

The nuclear family,

The dignity and sanctity of human life and hard work.

When the people who live in thus country deserve America, elections will be fair again. As long as too many of us allow the forces of evil to dictate policy and behavior, we as a people will continue to be the way we are.

They need to put a stop to surprise ballot drops.
Ballots need to be stored in a secure location in sealed boxes with registration numbers,
under 24 hour video surveillance.

One day to vote in person with paper ballots, picture ID. NO absentee or remote voting. Military to have voting precincts established on their bases. Election day to be a national holiday with all critical employees-police, fire, medical, EMT etc. given time off during the day to vote. All voting and counting to be observed by representatives of both parties. No non citizens to be allowed to vote in federal, state, or local elections. Any district that reports the count after a time cutoff must be disregarded regardless of the reasons given.

and no proxy voting. I would even prefer it were the age to vote to be raised to a least 25 or, better, to thirty except for active military and honorably discharged veterans.

Connecticut does a random audit on every election which I think goes something like this - Republicans get to choose precincts and Democrats can choose precincts. In the chosen precincts a hand count verifies the machine count. If there is more than .5 percent discrepancy they re-count the whole state.
https://verifiedvoting.org/auditlaw/connecticut/
This doesn’t prevent harvesting or prevent people from voting twice (e.g. absentee and then also in person) but it does prevent multiple scanning of the same ballots and tinkering with the machine software as in the Dominion accusations in 2020.

How can state election protocols permanently change to safeguard against fraud?

Take a step back, and see the problems.

Too big a job for paper, and all of the non-paper solutions above require specialized equipment that are brought out and dusted off every two years. The useful life for such specialized equipment is relatively shorts, which means more gear has to be regularly purchased, and the old gear committed to the electronic waste pile.

The size of the problem can't be fixed. One of the consequences of the size problem is that there just aren't enough hours in the election day to handle the traffic. That's one reason we have an election two-weeks or month, with the problem of long-term security of the vote as it is taken.

That doesn't get to the problem with mail-in ballots, which appear to exclusively use the optical mark-sense method and those pesky ovals. Not to mention the problem of enterprising people printing up and submitting bogus ballots to try to steal elections.

That doesn't mean that the other mechanical methods don't have methods to effect election shenanigans. (I remember as a grade school student looking at the back of one of those election monoliths, and seeing the counters were not all zero. But that's another story for another time.)

A more sensible solution is to abandon special equipment for elections, and utilize existing equipment -- at least in the polling place and on the voter side of the mailbox. Almost every single person in the United States has access to a computer of some kind. Work, home, library, FedEx Office. (Except the Amish and other electronic hermits.)

Further, decouple the preparation of the ballot from the submission of the ballot, so that instead of taking 10 minutes to record and submit your vote, you take your time off-site, then take five seconds to submit your choices to the polling clerk. This mimics what the US Census Bureau does when counting noses.

I agree there are problems with such a proposal -- I expect honorable people to debate the details, as well as the appropriate checks and balances.

Let the debates, and the blue-sky proposals, begin.

Death Penalty for Perjury!

Sounds like a terrible idea to me.

The government lies to us all the time. Why should we not lie to the government?

Perjury should be at most a misdemeanor offense with a small fine imposed.

Minor errors or omissions in any number of complex government forms can subject people to absurdly severe punishments "under penalty of perjury" at the whim of government officials. The FBI has become infamous for using "perjury traps" as a handle to force people into compliance with their frequently unlawful orders. That must stop. The way to make it stop is to lower the penalties.

Now, if you want "free and fair elections", we will something besides harsher punishments for laws which will not be enforced.

A few suggestions: We need to purge the current voter rolls in every State and begin with a blank slate.

Every new registrant must present some form of positive ID to get back on the rolls. Registrations should expire after two missed elections or ten years. Renewals can be handled by mail or online if done before expiration. Sort of the way drivers' licenses or car registrations are commonly done. Otherwise, it is back to a government office with a demonstration of positive ID.

Voters must be able to provide a mailing address which is a valid residence. No, that cannot be a vacant lot, a post office box, a church, or a homeless shelter.

"Non-Government-Organizations" must not be permitted to collect voter registrations. There has been too much fraud in such processes, always for the Democrats. Enough already! Registrations must be done at a government office.

Vote-by-mail should not be generally permitted. If it is permitted, it should only be on request of the voter. Drop boxes for such operations must be in secured government locations under 24 x 7 surveillance and collected daily using strict chain-of-custody procedures.

"Same day registration" and voting on the day of an election should not be permitted. This always results in attempts to swamp election systems with fraudulent registrations. Enough already!

The "Motor Votor" laws must be repealed or revised. States which do issue driver's licenses to non-citizens must clearly mark them as non-citizen identifications and inform licensees that they are ineligible to vote. In no cause should persons be automatically registered to vote, simply because they obtain a State-issued ID, although it might reasonably be offered as an option.

I remember as a grade school student looking at the back of one of those election monoliths, and seeing the counters were not all zero...

I remember as a high-school student watching a technician setup a voting machine in the gymnasium. He had a list of counters that he was setting to non-zero starting values for certain candidates. "It came from the head office. That is just how we do it", he said in response to my questions.

I have never really trusted voting machines since that time, decades ago. I note that elections in that city always favor Democrats even to this day. I do not believe elections there have ever been honest.

"Elections" which come down to very low margins of victory (Less than 1%) should probably be redone with additional scrutiny. The old ballots should not be recounted. There is too much margin-of-error, and way too much incentive for cheating in a recount.

We could technically have online voting systems which accurately and securely collect one-person-one-vote in our elections. Unfortunately, we cannot trust the people who would build and operate those systems. There is again, too much incentive to cheat, and not enough people with skills who can audit those systems to prevent cheating.

A zero-trust organization of skilled adversarial groups could make online voting systems work. That would require open-source code and very strict chain-of-custody rules for every step of deployment and operation of those systems. It would be extremely expensive, but it could work. Even so, the expertise required is well beyond comprehension of the average citizen and once again depends on "trusting a bunch of experts" who, quite frankly, can do nothing to inspire such trust.

It always comes down to tallying large numbers of paper ballots and preventing injection of fraudulent ballots or miscounting ballots as the least costly and most acceptable system for ordinary people to have confidence in it.

“...but the Congress may at any time by Law make or alter such Regulations, except as to the Places of choosing Senators.”

This is very clear, i.e., Congress can change or make any state’s voting regulations.

The idea that paper ballots are now obsolete because of population growth is beyond absurd. One of the most corrupt countries in the world, viz., Italy (population just less than 60 mill.), has only one election day, no ballot harvesting, very limited absentee ballot use, and they use paper ballots. AND they know the results the next day. There is no state in the union with a population of even 60% of Italy’s.

There must be a hardcopy (paper) to allow for the audit of election results. From IBM punch cards to graphite filled-in choice-boxes...there must be paper back-up to the electronic count. Going paperless creates HUGE possibilities for cheating and is part of our stupid addiction to...I’m like...OMG...INNOVATION!!!
