AP reports that noncitizen voting has become GOP talking point even though it's illegal

The Biden campaign keeps trying to hit on Speaker Mike Johnson for a bill making it illegal for noncitizens to vote in federal elections. It's already illegal, so what's he trying to prove? Sen. Mike Lee recently posted a lengthy thread on just how "shockingly easy" it is for noncitizens to vote. As we reported, a Mexican NGO called Resource Center Matamoras has been distributing flyers to illegal immigrants encouraging them to vote for President Joe Biden. "Reminder to vote for President Biden when you are in the United States. We need another four years of his term to stay open," the flyer reads.

Christina Pushaw noticed the Washington Post shift from "it's not happening" to "it's happening, but it's rare."

What does the Post mean by noncitizen voting is "rare"? How rare? Once is too many times. Not to mention that President Joe Biden recently slipped up and said the millions of illegal immigrants who've crossed the border during his administration are "model citizens."

Now the Associated Press is carrying water for the Biden campaign, noting that noncitizen voting, while already illegal, has become a centerpiece of Republican messaging. Maybe Republicans are concerned that millions of "model citizens" have been imported since the previous election.

Illegal is one thing, but a better question is whether there are things being done to prevent it from happening. Do some states, for example, require proof of citizenship to register to vote or do you just have to check a box claiming you are a citizen?

As Lee said, it's basically the honor system.

The issue isn't if it's legal or not, it's the fact that it is happening. Even one illegal vote means the election isn't legitimate.

They have no idea how many non citizens vote. Most states have no requirement to prove citizenship to register and some require as little as a utility bill to show residency.

The once solid red Atlanta suburbs who gave us Newt Gingrich suddenly and flipped after 2012 and I am suspicious.

There is some evidence for such suspicion, at least in the 2020 election.

It has been reported in one of those solid red suburbs there is evidence of a number of visits to the Dominion voting machines by its tech employees or reps to do a number of "services" before, during and after the election.

Such visits might be warranted if the machines were troublesome or as unreliable as a flickering light bulb.

The kicker here is that the chain of custody records mandated by law for such visits, which also required presence of local authorities, that detailed such "services" was either not maintained, has been destroyed or is otherwise unavailable.

(This is per my best recollection and may not be precisely accurate.)

OK, I guess it’s about whether the person has to prove their eligibility to vote. AZ requires proof of eligibility but a judge ruled that the Motor Voter Act governs presidential and federal elections and doesn’t require any proof so states can’t require any proof of voter eligibility for federal elections. So AZ uses a form where people who don’t want to provide proof of citizenship to simply sign their names to a statement saying they are US citizens when they request a federal ballot.

It seems like the federal law has a loophole for people who think they are citizens to vote. Frog in a pot, what part of that federal law is it that you believe closes that loophole?

Thing is, even if there is a provision to punish those who vote after falsely swearing that they are US citizens, by then the damage is done, unless those votes are kept as provisional votes to be counted only AFTER citizenship is proven.

Did the judge rule that HAVA (Help America Vote Act) means that everybody who the federal law says has to be allowed to vote (even those who haven’t proven citizenship) also have to have their votes necessarily counted rather than cast as provisional votes?

Even if 2 million newcomers were given voting privileges I doubt they’d vote for Biden. They can see a fool coming and don’t want the government dream for life.

The democrats themselves in their canvassing drives, but also their allies, like the SEIU union, the NEA, etc.

Apparently. This Clinton-nominated judge is arguing the fed act presents the only test a registering voter has to pass. That test is the bare assertion under penalty of perjury as to being a citizen. At the moment, she may be correct.

In 2004, Arizona passed Prop 200, which required voters to provide proof of citizenship when registering to vote or casting a ballot. It reached the USSC which held the NVRA preempts voter registration requirements beyond the bare assertion. It held in part that to allow states to impose additional requirements would allow them to reject voter registrations applicants who met the federal requirements to vote, which would defeat the purpose of the Act. (Alioto and Thomas dissented.)

The result seems to fly in the face of the long-standing view the Constitution grants the power to decide voter qualifications in federal elections to the states. Fortunately, Arizona is well aware of this 10+ year old USSC holding and this case is yet proceeding.

The Congress, however, would be entirely correct at the next Jan 6 Joint Session to conclude on the basis of current events (open borders + the active importation of immigrants) that ignoring the well-established rule by both state and federal governments prohibiting noncitizen voting for fed offices is contrary to common sense. Perhaps most importantly it dramatically increases the risk to national security.

Among other devices, noncitizen voting is just one, the Congress could ask each State to submit the means by which it tested each registrant's assertion.
