Under Biden, the DOJ weaponized the Freedom of Access to Clinic Entrances (FACE) Act, a 1994 law that prohibits interfering with anyone obtaining or providing “reproductive health services,” as a punishment for the Supreme Court’s reversal of Roe v. Wade in June 2022.
After the Supreme Court ruling, Biden formed the DOJ-led Reproductive Rights Task Force to enforce the act.

When you work for Joe Biden, laws really are for the little people — even when you’re in charge of enforcing them. Witness Black Justice Department civil rights chief Kristen Clarke, who’s admitted that she lied during her 2021 Senate confirmation process.
Asked by Sen. Tom Cotton (R-Ark.) if she had “ever been arrested for or accused of committing a violent crime against any person,” Clarke answered no. In fact, she had been — on a 2006 domestic violence complaint when she allegedly sliced open her hubby’s finger with a knife.
Clarke’s now arguing that because the arrest was expunged, she wasn’t required to disclose it to lawmakers. That’s precisely the kind of razor-sharp logic that top Biden appointees are known for.
Then again, Clarke’s the same dunderhead who muffed a major question about First Amendment litigation last year, claiming in a congressional hearing to be totally unaware of the lawsuit by the state of Missouri against the president over government efforts against “disinformation” — a huge civil rights issue where Team Biden had lost and was appealing to the Supreme Court. Her defense now is beyond pathetic.
Black DOJ official Kristen Clarke reluctantly comes clean after falsely testifying to Senate that she had never been arrested. She told an unambiguous lie to Congress. Was she thinking she’d never get caught, or that if she did, her political connections would protect her? It’s of a piece with the overall attitude of Biden’s circle: If you have the power, laws don’t apply to you.
That a scofflaw like this should serve at such a high level in the Justice Department is beyond absurd. How can someone who seemingly lies under oath be trusted with seeing that laws are properly enforced and justice is truly served? Not that Clarke’s previous record was stellar.
She lobbied the Obama administration, way back in 2009, to let Black Panthers who terrorized black poll workers off the hook. She served on an academic journal with antisemitic 9/11 truther Amiri Baraka, and lied about that too. In other words, she’s a radical to the bone.
But that’s a plus in this administration: Biden has remade Justice into the enforcement arm of his political agenda, siccing the FBI on (for example) parents who protest school boards. To Bidumb, ideology is what matters, not integrity.

Wade. She also oversees investigations into violations of the Freedom of Access to Clinic Entrances Act—which she has used to charge 26 pro-life individuals this year.
“It appears she’s violating her oath of office and she’s violating her duty, which is to fairly administer the law regardless of political views,” John Daukas, former acting assistant attorney general for civil rights in the Trump administration, told The Daily Signal. “She appears only to be prosecuting groups that she doesn’t like, doesn’t agree with.”
Few would expect such a high-ranking DOJ official to retain the slew of political hot-takes and public condemnations that litter Clarke’s social media from before she assumed her current role. She has called Alliance Defending Freedom a “hate group” and Liberty University a “fundamentalist Christian school.” She has said that those protesting Dr. Anthony Fauci should be “publicly identified and named, barred from treatment at any public hospital if/when they fall ill and denied coverage under their insurance.”
She has hurled insults at Republican politicians from Lisa Murkowski to Donald Trump, supported the allegations of Christine Blasey Ford, and has submitted testimony to the U.S. Senate that Amy Coney Barrett was unfit to serve as a justice because she would likely rule to overturn Roe v. Wade (which Clarke vociferously and publicly supported). She has frequently critiqued pro-life laws and courts that upheld them, branding a law protecting Down Syndrome babies “draconian.”
Significantly (in light of the scores of recent attacks on pro-life centers following the Roe v. Wade leak), Clarke called pro-life pregnancy care centers “predatory” and “fake clinics,” claiming they are part of a “coordinated strategy to tear down Roe” (as The Washington Free Beacon’s Chuck Ross reported).
Clarke has heavily toned down her activist rhetoric since her nomination to the Justice Department. The Daily Signal reached out to her multiple times through various avenues to obtain comment for this story, but a spokesperson declined to comment on her behalf.
Her politically charged comments call into question “her ability to impartially enforce the law,” according to Roger Severino, the former director of the health department’s Office for Civil Rights who also formerly served as a trial attorney in the DOJ’s Civil Rights Division.

In September 2023, Lauren Handy, 28, of Alexandria, Virginia; John Hinshaw, 67, of Levittown, New York; Heather Idoni, 61, of Linden, Michigan; William Goodman, 52, of Bronx, New York; and Herb Geraghty, 25, of Pittsburgh were found guilty of conspiring to blockade access to the clinic which can be a 50 year sentence.
But my main question is how are the facing such a long term when people have been blocking public roadways and federal buildings and getting out on bail immediately and given misdemeanor sentences? Justice?
