New Mexico AG to Governor on Defending Her Second Amendment Suspension: Drop Dead

here are now six lawsuits (and counting) challenging New Mexico Governor Michelle Lujan Grisham’s public health order suspending Second Amendment carry rights in the Bernalillo County and the city of Albuquerque. While literally no local authorities are willing to enforce her clearly unconstitutional diktat, Grisham is still claiming that the New Mexico State Police will do her dirty work.

The State Police, however, have remained strangely silent on the matter and no one has been cited for any violations.

This afternoon, however, New Mexico Attorney General Raúl Torrez delivered the latest body-blow to the Governor’s authoritarian tendencies by announcing in a letter to Grisham that his office will not be defending her in court.

“Though I recognize my statutory obligation as New Mexico’s chief legal officer to defend state officials when they are sued in their official capacity, my duty to uphold and defend the constitutional rights of every citizen takes precedence,” Torrez’s letter stated. “Simply put, I do not believe that the Emergency Order will have any meaningful impact on public safety but, more importantly, I do not believe it passes constitutional muster.”

I rather figured people had lawsuits prepared. All they had to do, was plug the names in.

Given the Supreme Court declaring RKBA a civil right, anyone trying to enforce the gov’s order risks running afoul of various civil rights laws.

Title 18, U.S.C., Section 242 - Deprivation of Rights Under Color of Law

This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.

I doubt she feels an iota of shame or humiliation for her audacity but will relentlessly attack the 2A for the rest if her career. I also doubt she will pay any political price for what she has done from her party, political peers (of any stripe, repro-RINO) or the electorate.

He is a radical Soros communist DA from Albuquerque, before he became AG.

This is just a “good cop, bad cop” act. New Mexico’s gun laws are very lenient. His intent is that backing down from this blatantly illegal order, he will then support “reasonable” (New York/California) gun laws in the January legislative session.
Also MLG is term limited and he intends to run for Governor.

All an act, art of the deal stuff. Ask for something way over the top, then “settle” for what you really wanted all along.

Like I said elsewhere, gun nuttery in NM even if it is democratic is more rampant than it is in Texas and this outcome was predictable. And by the way, being accused of beign a gun nut in the state of Texas is a point of pride unless you’re some sort of communist. Local sherrif after a convo with Mrs. Jackson told her she needed to carry because if he had to come sort out a mess she got in he was going to cite her as a public nuissance.

I believe the order was for 30 days by the time the lawsuits are heard it will be moot. I hope they go forward and that lawless skank get smacked down like an undercard wrestler.

Why is the left coming out against this loony action? Because they don’t want a court to rule against her declaring a health emergency as a basis to suspend constitutional rights. They are saving that for something bigger, later.

Once a court rules that rights cannot be suspended in an emergency...again...(SCOTUS has ruled on this a long time ago)...then it becomes easier to get a quick injunction against it.

This is a stinker of a case that will damage the plans of our ruling elites. They will never let it see the front steps of a courthouse.

The state police head is appointed by her. The sheriff’s are elected locally and report to no one except the voters.
