Trump's Lawyer John Lauro: Newest Indictment Gives Trump Legal Power That He Never Had Before

Former President Donald Trump attorney John Lauro sees at least one silver lining in the Department of Justice’s latest indictment of his client: Trump will get to litigate why he believes the 2020 presidential election was fraudulent.

“In 2020 Mr. Trump’s campaign had a few weeks to gear up and present evidence, and it was very difficult,” Lauro told Fox News host Bret Baier Tuesday night after special counsel Jack Smith announced the 45th president was being indicted in relation to his questioning of the integrity of the 2020 election.

“We now have the ability in this case to issue our own subpoenas, and we will re-litigate every single issue in the 2020 election in the context of this litigation,” Lauro added. “It gives President Trump an opportunity that he has never had before, which is to have subpoena power since January 6 in a way that can be exercised in federal court.”

Trump created “widespread mistrust” in his attempt to “overturn the legitimate results of the 2020 election,” Smith alleged.

Further, the former president knew that his allegations of election fraud were false when he made them, the special counsel added.

Lauro refuted that Trump knowingly made false statements about the election, but even if he did, it is still protected free speech under the First Amendment.

“It’s not just issues of fraud. It’s also the fact that procedures were changed, undeniably so, that procedures at the state level were changed without the ability of the legislature to weigh in,” Lauro explained.

Trump’s intention on Jan. 6, 2021, was to pressure Congress not to certify the Electoral College vote, so the state legislatures could have one last chance to review and weigh in on how the elections in their states had been conducted.

I think this is a very important point, but I can’t believe the Dems missed it. Keep your eye on them…they will use every strategy posible to keep this from happening.

Trump’s team will only have the subpoena power that the (Obama appointed) Judge Tanya Chutkan allows them to have.

It’s not a blank check to subpoena every voting record in the country.

Yes, President Trump doesn't have to prove that the election was stolen; he just has to prove that he believed the election was stolen and acted on that belief.

Lauro stated they wanted the state legislatures to weigh in on the legitimacy of the vote for their electors.
Bret Baier countered that the states already did certify their elections because the governors had signed off on them.
This, after the rules and procedures had been changed during the pandemic without legislative approval.
The US Constitution vests the power over procedures for federal elections to state legislatures, not their executives.

What I believe is that an activist judge will do activism. Most certainly to the point of mistrial, but at very least overturned on appeal. Jack Smith seems to view “overturned on appeal” to be good work that served his purpose, which is election interference, not justice.

She has a problem. Smith’s indictment alleges the President knowingly made false statements. If Trump choosrs an affirmative defense then he has a right to eother prove his statements true or prove belief they were true to be reasonable. She cannot deny him any evidence or witness that goes to those ends. Smith can withdraw that part of the indictment, but then his whole case falls apart.

Why are people talking as if this were going to be a real trial? The Judge is a lunatic Democrat activist who does not care what the truth is or what the law says.

She's so stupid she may not grasp that she's just going to get overturned when it gets kicked up high enough.

This "trial" is just a Kabuki dance, as are most trials. Truth doesn't matter, what the law really is doesn't matter, the only thing that matters is the raw exercise of power by whim of the judge.

So to your point, which may not be a bad angle, is that Trump STATES all the things he believes happened and the fedgov must then submit proof he’s wrong(?)

DJT should have the RIGHT to free speech but we know where this is going....

They will absolutely disallow much of his efforts on the basis of outcomes in other litigation on the matter. It’s ‘settled’ and they won’t re-litigate it.

Right now, I’m not sure if Nancy Pelosi or Joe Biden will be the first person named on Trump’s witness list. Both of these people could be sitting through dozens of hours of depositions if this case isn’t dropped by the prosecution.

Wouldn't that be something. Not sure he could pull enough out of them to help Trump's case more than hurt it though, but the thought of badgering them good is a fun thought.

Well...

The distinction here is that if President Trump's lawyers were to say they want the government to disprove what President Trump believed, the judge could rightfully block that evidence since this isn't a case of proving the integrity of the 2020 election.

HOWEVER... if Trump's lawyers say they are introducing evidence only to show the state of mind of Trump as cause for him to believe he was the actual winner of the 2020 election, I don't see how the judge can refuse that evidence to be used in that limited way.

Then it falls on the prosecution to prove that no reasonable person could come to the conclusion that President Trump came to based on the evidence. Trump's team could rebut that claim by simply presenting published news articles and TV interviews discussing both sides of this as evidence that the LAAP-dog media believed it enough to present news stories about it, so why shouldn't the President have believed it, too?

I'd stay away from discussing the turnout at rallies as evidence that plenty of "reasonable people" believed it too, because that opens up the door for the prosecution to then pivot to the J6 rally and say that those people weren't "reasonable" when they stormed the Capitol building despite about 80,000 peaceably assembling prior to Capitol riot starting.

Trump has the election won it’s why the democrats are in kill mode they have everything to lose the party will be crippled for ever.
Many democrats voters are switching to the independent party for the actions of the party and all the chaos from Biden’s day one.

No, Trump didn't do that. We SAW key states all stop counting votes AT THE SAME TIME and then RESUME at the same time all showing HUGE votes for Biden with near 0 for Trump.

Anyone who saw the stats on vote totals before key states suddenly stopped, then again when "counting" resumed knows the fix was in. What happened in key states was statistically IMPOSSIBLE.

Don't treat us like we're stupid.
