Did Harvard’s Larry Tribe Really Just Advise Biden to Ignore Law on Debt Ceiling?

Harvard Law School’s bonafide leftist Laurence Tribe didn’t see the ethics issue in advising President Joe Biden to ignore standing law on the debt ceiling in order to … uphold the law.

Tribe penned an idiotic May 7 op-ed pontificating that it is supposedly the “essence of constitutional leadership, not the action of a tyrant” for Biden to ignore the law on the debt ceiling created by Congress. How is using carte blanche authority to cherry-pick which laws to uphold and which to ignore not the actions of a “tyrant?" Tribe piggy-backed off a nutty reading of the 14th Amendment to clamor that “Mr. Biden must tell Congress in no uncertain terms — and as soon as possible, before it’s too late to avert a financial crisis — that the United States will pay all its bills as they come due, even if the Treasury Department must borrow more than Congress has said it can.” [Emphasis added.]

This is a complete about-face from Tribe’s argument in 2011 when the Obama administration faced a similar debt limit hurdle. In short, Tribe repudiated the very same position 12 years ago that he’s advocating for now: “If the president could usurp the congressional power to borrow, what would stop him from taking over all these other powers, as well?” But now, Tribe’s latest headline suggests he’s abandoning reason for madness: “Why I Changed My Mind on the Debt Limit.”

You see, I sense a flaw in this logic and a sustainability problem in the strategy but Tribe is a PhD I think so he must know what he's talking about. Right?

Frankly, I can see if Potato Joe does it, CONgress will begin impeachment hearings, maybe. Probably sternly worded letters and whining instead. You could then bet on it being drawn out for months and months, then the Senate having a few Repuke turncoats not convict.
That’s if CONgress even does anything.

Tribe is overrated as an appellate attorney. He wins cases preaching to the choir before majority liberal appellate courts who decide cases on the basis of Democrat policy perspective not law and gets his ass kicked in appellate courts with majority conservatives. His problem is his advice is worthless with a majority conservative Supreme Court where he hasn’t won a case involving political policy in years.

Harvard just isn’t the same since it became a catch all for the low I.Q./Low income affirmative action types who want to be college students so they have a cool college T-shirt to wear to spring break.

THE ONLY legal and Constitutional route for a president if Congress does not raise a debt ceiling and federal revnue cannot cover federal expenses, is for the President to instruct the treasury to pay the interest on current debt obligations before making any other federal payments, and to continue to do so as long as possible. Until the Biden admininistration does that, and unless they do that, any “default” is on Biden’s shoulders.

Tribe needs to be reminded, the federal debt obligations are the ONLY thing the Constitution mandates must be paid. The rest can be deferred as needed.

Federal employees can be put on unpaid furlough, and/or vouchers to those who must be kept working (the military) and venders can also be given vouchers they can turn in later when the “debt ceiling” issue is past. Some vendors will be able to get short term bank loans against the federal vouchers to help cover what of their own payrolls they must make. The Federal Reserve can even backstop those loans.

If the U.S. defaults it will be Biden’s fault.

Age not issue. Issue is debility of not gaining wisdom during the process of aging. These old stool samples are still stuck in rot from the past like socialism..haven’t learned a damn thing in life.
